On February 12,2018, Officer Cunningham posted the property with a condemnation <br /> placard that was issued due to the dangerous and unsafe electrical and mechanical systems <br /> in the residential structure on the subject property. In the City of Everett electrical <br /> equipment that is found to be dangerous and unsafe renders a residential structure unfit for <br /> human habitation. A notice of condemnation was mailed to the Respondents via first class <br /> mail and certified mail. A copy of the notice was posted on the subject property. The notice <br /> informed the Respondents of the violations on the subject property and ordered that the <br /> basement level of the residential structure be vacated no later than March 12,2018 and that <br /> the entire residential structure be vacated no later than April 9,2018. (Exhibit#4, <br /> Declaration of Service, dated February 12, 2018 with photos) (Exhibit#8, Notice of <br /> Condemnation, dated February 12, 2018 with mail receipts) (Testimony of Code <br /> Enforcement Officer Cunningham) <br /> 8. On February 13, 2018, Grace Pollard, City of Everett Assistant Planner,informed Officer <br /> Cunningham that the lot was too small to approve an application to convert the multiple <br /> family structure into an approved duplex but an accessory dwelling unit(ADU)could be <br /> possible in a single-family structure if one of the units is owner occupied. (Testimony of <br /> Code Enforcement Officer Cunningham) <br /> 9. As of March 20, 2018,the Respondents had not applied for or obtained required City <br /> permits for the construction alterations conducted on the single-family residential structure <br /> located on the subject property. Respondent Jeremy Jones informed Officer Cunningham <br /> that all but one tenant had vacated the structure and that they intend to rent the structure as a <br /> single-family dwelling only. (Testimony of Code Enforcement Officer Cunningham) <br /> 1 <br /> 8 <br /> 10. The City provided the Respondents with an opportunity to correct the conditions that were <br /> in violation of sections of the EMC and provided notice of the date,time, and place of this <br /> hearing. Respondent Jeremy Jones appeared at the hearing. <br /> 11. Chief Inspector de Budden testified at the hearing the use of portable electric heaters in all <br /> five units could over draw the electrical usage on the current 200 amp service causing an <br /> electrical hazard. He stated that the venting of the hot water tank was not installed lawfully <br /> and that the current installation could cause carbon monoxide levels to increase in the <br /> enclosed area. (Testimony of Chief Inspector de Budden) <br /> 12. Officer Cunningham testified at the hearing that if the use of a property had been converted <br /> lawfully by obtaining permits for the work conducted during a conversion,then the building <br /> could be certified non-conforming in the City. However,if the conversion was conducted <br /> without required City permits,then a non-conforming certificate could not be issued. <br /> (Testimony of Code Enforcement Officer Cunningham) <br /> 13. Respondent Jeremy Jones testified at the hearing that they had purchased the property in <br /> 2014 and that they referred to the information from the County and the real estate listing <br /> which showing a four plex on the subject property. Upon purchase of the property,they <br /> rented all five units of the subject property. They discovered that the electrical service on <br /> the property was not sufficient and they applied for permits to upgrade the electrical service <br /> 4 <br />
