3. The electrical and mechanical equipment serving the residential structure on the subject <br /> property had been compromised causing the structure's electrical and mechanical equipment <br /> to be unsafe and dangerous,rendering the structure unfit for human habitation as defined by <br /> IPMC 108.1.2 and IPMC 108.1.3. Such condition is a violation of IPMC 106.1. The record <br /> demonstrates said City ordinance was violated. <br /> 4. The current occupancy of the single-family residential structure fails to comply with <br /> provisions of the EMC Title 19,as the number of units created means that occupancy of <br /> those units by unrelated persons violates EMC 19.41.030(A)and(B). The record <br /> demonstrates said City ordinance was violated. <br /> ORDER <br /> Based on the findings of fact and conclusions of law stated above,it is hereby determined that <br /> the Respondents allowed violation of IPMC 106.1,IRC R105.1,and EMC 19.41.030(A)and(B) <br /> on the subject property and are hereby ordered to: <br /> 1. The Respondents must abate all violations of IPMC 106.1, IRC R105.1, and EMC <br /> 19.41.030(A)and(B)on property located at 2306 Rainier Avenue,Everett, Washington. <br /> 2. Abatement shall include the following: <br /> a. The residential structure on the subject shall remain secured from trespass and <br /> property p <br /> shall remain vacant until occupancy is approved by the City of Everett Building <br /> Division. <br /> b. The Respondents shall apply for and obtain all of the necessary and required permits to <br /> bring the property into compliance with City ordinances. The Respondents shall have a <br /> qualified contractor conduct and complete all of the required work, and shall have the <br /> work inspected and approved by the City of Everett Building Division within 12 months <br /> or by March 29,2019. <br /> c. Any violations not listed in this Order are subject to standard enforcement processes and <br /> procedures. <br /> 3. The Respondents shall be fined$500.00 for each violation of IPMC 106.1,IRC R105.1,and <br /> EMC 19.41.030(A) and(B)for a total fine of$1500.00. Of the total fine, $1200.00 shall be <br /> suspended provided the Respondents comply with items 2a-2c by March 29,2019. If <br /> compliance has not been met or if a same or similar violation occurs on the subject property <br /> within 24 months,the suspended portion of the fine shall be immediately due to the City. <br /> 4. The Respondents shall pay the$300.00 non-suspended fine no later than April 13,2018. <br /> Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100,Everett <br /> Washington,98201. If payment is not made on or before April 13,2018 collection action <br /> will be taken,which may include assigning the debt to a collection agency pursuant to EMC <br /> 1.20.050(D). 1 <br /> 7 <br />
