" 1 ORDINANCE NO. 3827 AN ORDINANCE REGULATING OUTDOOR SWIMMING POOLS; REQUIRING A LICENSE; AND PRESCRIBING PENALTIES FOR VIOLATION HEREOF. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1 : A swimming pool shall be defined as a body of water in an artificial or semi-artificial receptable located outdoors having a maximum depth of 2 feet or more, used or intended to be used for public, semi-public or private swimming, whether or not any charge or fee is imposed, includ- ing all swimming pools operated or maintained in conjunction with any club, hotel, motel and/or community association. SECTION 2 : Before work is commenced on the construct- ion of a swimming pool or any alterations or additions, remodeling or other improvement to a swimming pool, application for per- mit to construct and the plans and specifications and pertinent data shall be submitted to the building inspector of the City of Everett and a permit shall be issued as provided by the Building Code of the City of Everett and all other ordinances of the City of Everett affecting the same. SECTION 3: No person shall operate or maintain an outdoor swimming pool until a license shall have been issued by the Building Inspector of the City of Everett, which license shall not be valid for more than one year from date of issue. All licenses shall be in writing and state the conditions there- of and the terms for which the license is granted. SECTION 4: It shall be unlawful for any person to own, conduct, operate, maintain or manage any outdoor swimming pool without complying with the requirements of this ordinance . SECTION 5 : Any license granted by the Building In- spector hereunder may be revoked by him for failure to comply with this ordinance, the rules and regulations of the State De- partment of Public Health or the Snohomish Health District. SECTION 6: The holder of any license which may have been revoked may appeal to the City Council, and the City Coun- cil shall determine the legality or reasonableness of the re- vocation of the license. No appeal under this section, however, shall entitle the license holder to continue operation of the swimming pool pending action by the City Council. SECTION 7: Every outdoor swimming pool shall be surrounded by a fence or wall of not less than forty-two inches (42" ) in height, which shall be so constructed as not to have openings, holes, or gaps larger than four inches (4" ) in any dimension except for doors and gates; and if a picket fence is errected or maintained, the horizontal dimension shall not exceed four inches ( 4" ) .
