" 1 <br /> ORDINANCE NO. 3827 <br /> AN ORDINANCE REGULATING OUTDOOR SWIMMING POOLS; <br /> REQUIRING A LICENSE; AND PRESCRIBING PENALTIES <br /> FOR VIOLATION HEREOF. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1 : A swimming pool shall be defined as a <br /> body of water in an artificial or semi-artificial receptable <br /> located outdoors having a maximum depth of 2 feet or more, used <br /> or intended to be used for public, semi-public or private <br /> swimming, whether or not any charge or fee is imposed, includ- <br /> ing all swimming pools operated or maintained in conjunction <br /> with any club, hotel, motel and/or community association. <br /> SECTION 2 : Before work is commenced on the construct- <br /> ion of a swimming pool or any alterations or additions, remodeling <br /> or other improvement to a swimming pool, application for per- <br /> mit to construct and the plans and specifications and pertinent <br /> data shall be submitted to the building inspector of the City <br /> of Everett and a permit shall be issued as provided by the <br /> Building Code of the City of Everett and all other ordinances <br /> of the City of Everett affecting the same. <br /> SECTION 3: No person shall operate or maintain an <br /> outdoor swimming pool until a license shall have been issued by <br /> the Building Inspector of the City of Everett, which license <br /> shall not be valid for more than one year from date of issue. <br /> All licenses shall be in writing and state the conditions there- <br /> of and the terms for which the license is granted. <br /> SECTION 4: It shall be unlawful for any person to <br /> own, conduct, operate, maintain or manage any outdoor swimming <br /> pool without complying with the requirements of this ordinance . <br /> SECTION 5 : Any license granted by the Building In- <br /> spector hereunder may be revoked by him for failure to comply <br /> with this ordinance, the rules and regulations of the State De- <br /> partment of Public Health or the Snohomish Health District. <br /> SECTION 6: The holder of any license which may have <br /> been revoked may appeal to the City Council, and the City Coun- <br /> cil shall determine the legality or reasonableness of the re- <br /> vocation of the license. No appeal under this section, however, <br /> shall entitle the license holder to continue operation of the <br /> swimming pool pending action by the City Council. <br /> SECTION 7: Every outdoor swimming pool shall be <br /> surrounded by a fence or wall of not less than forty-two inches <br /> (42" ) in height, which shall be so constructed as not to have <br /> openings, holes, or gaps larger than four inches (4" ) in any <br /> dimension except for doors and gates; and if a picket fence is <br /> errected or maintained, the horizontal dimension shall not <br /> exceed four inches ( 4" ) .
