r <br /> VOL 104 PAGE a., . <br /> Section 15.04.330 Appellant Any person or persons <br /> aggrieved, or any officer, official of any department, <br /> board or commission of the City, jointly or severally, <br /> may be the appellant, and may make a request for a <br /> special exception to the Board for relief from any pro- <br /> vision of the zoning ordinance or any determination of <br /> the Building Inspector in the application of the pro- <br /> visions of the zoning ordinance to the appellant's land <br /> and/or structure except that the Board shall not be per- <br /> mitted to grant a use not allowed in the zone in which <br /> it lies or to make any change of a boundary line of a <br /> zone. The appellant shall appear at the public hearing <br /> at the time and place fixed by the Board in person, by <br /> agent, or by attorney. <br /> Section 15.04.350 Initiation of Action The Board <br /> may initiate a review of the 'Building Inspector's in- <br /> terpretation of the provisions of the zoning ordinance <br /> by a motion, or by virtue of a vote by a majority of <br /> the members present; it shall also review any inter- <br /> pretation of the provisions of the zoning ordinance made <br /> by the Building Inspector and any order, requirement, <br /> decision, or determination relating thereto, upon re- <br /> ceipt of an application or petition requesting a re- <br /> view of the interpretation; and it shall hear and de- <br /> oide all applications for variances. <br /> Section 15.04.360 Jurisdiction - Review of De- <br /> cision of Building Inspector: <br /> The Board may review any interpretation of the pro- <br /> visions of the zoning ordinance made by the Building <br /> Inspector, and any order, requirement, decision, or <br /> determination relating thereto, in the application of <br /> the specific provisions of the zoning ordinance to <br /> any parcel of land and/or structure. The Board may <br /> affirm or reverse the interpretation of the provisions <br /> of the zoning ordinance made by the Building Inspector, <br /> and any order, requirement, decision, or determination <br /> relating thereto; and the findings in each case, and <br /> to that end it shall have all of the powers of the <br /> Building Inspector except that in the Exercise of its <br /> powers, the Board may not by any act or interpretation: <br /> a. Change the boundaries of a zoning district <br /> b. Change the zoning rules regulating the use of land <br /> c. Hear appeals from decisions of the City Planning <br /> Commission. <br /> Section 15.04.370 Jurisdiction Variances; The <br /> Board may authorize variances in specific cases from the <br /> provisions or requirements of this Ordinance, not other- <br /> wise restricted in this section, as will not be con- <br /> trary to the public interest; but only where, owing to <br /> special conditions pertaining to a specific piece of <br /> property, the literal enforcement, of the provisions or <br /> requirements of this Ordinance would cause undue and <br /> unnecessary hardship.
