ORDINANCE NO. 3328. <br /> AN ORDINANCE RELATING TO THE MUNICIPAL WATER SUPPLY <br /> SYSTEM OF THE CITY OF EVERETT, PROVIDING RULES AND REGULATIONS <br /> FOR TEE CONTROL OF SAID SYSTEM, REGULATING THE USE OF WATER THERE- <br /> FROM, PROVIDING FOR THE SALE OF SA_-:E, FIXING THE PRICE THEREOF, <br /> AND PROVIDING A Y±THOD OF COLLECTING RATES THEREFOR, PROVIDING <br /> PENAL2IES FOR VIOLATIONS, AND REPEALING ORDINANCE NO. 2582 AND <br /> ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: There is hereby created in the Department of <br /> Public Works of the City of Everett a sub-department to be known <br /> as the Water Department. <br /> Section 2: The word "Superintendent" wherever used in <br /> this ordinance shall be held and construed to mean• the "Superin- <br /> tendent" of the Water Department of the City of Everett, and any <br /> act in this ordinance required or authorized to be done by the <br /> Superintendent may be done on behalf of the Superintendent by an <br /> authorized officer or employee of the Water Department. The word <br /> "Person" or "Customer" wherever used in this ordinance shall be <br /> held to mean and include persons of either sex, associations, <br /> co-partnerships, and corporations, whether acting by themselves <br /> or by a servant, agent or employee, the singular number shall be <br /> held and construed to include the plural and the masculine <br /> pronoun to include the feminine. <br /> Section 3: The Superintendent of the Water Department <br /> shall be a licensed Hydraulic Engineer of the State of Washington <br /> and shall be experienced in the managment and operation of water <br /> and hydraulic systems and shall have in his charge and under his <br /> control subject to the Commissioner of Public Works, the manage- <br /> ment, maintenance, and operation of the Water Department of the <br /> City of Everett including the Sultan River Water Supply System <br /> and all auxiliary pumping apparatus, reservoirs, pipes and of all <br /> persons employed thereon, and of all construction work undertaken <br /> by the City in connection with said water system. <br /> The official title of said Superintendent shall be Super- <br /> intendent of Everett Water Department. He shall be appointed by <br /> the Commissioner of Public Works and his appointment shall be <br /> confirmed by the City Council of Everett. He shall be the admin- <br /> istrative head of the Water Department with authority to employ <br /> and discharge employees of said department by and with the advice <br /> and consent of the Commissioner of Public Works of said City. <br /> Section 4: The salaries of officers and employees of the <br /> Water Department shall be fixed by the City Council of Everett, <br /> by ordinance, to conform with the departmental budget, as author- <br /> ized by the Council. <br /> Section 5: Overhead Charges: <br /> There shall be charged to the Water Department such sum <br /> per annum as the City Council may fix as a General Expense item, <br /> for reimbursement to the Department of Finance, Public Works, and <br /> Safety, and the Office of City Attorney for general supervision <br /> and additional work of said departments for the Water Department. <br /> Section 6: Accounts: <br /> The City Clerk shall keep the Water Accounts for the Water <br /> Department, <br />
