ORDINANCE NO. 3328. AN ORDINANCE RELATING TO THE MUNICIPAL WATER SUPPLY SYSTEM OF THE CITY OF EVERETT, PROVIDING RULES AND REGULATIONS FOR TEE CONTROL OF SAID SYSTEM, REGULATING THE USE OF WATER THERE- FROM, PROVIDING FOR THE SALE OF SA_-:E, FIXING THE PRICE THEREOF, AND PROVIDING A Y±THOD OF COLLECTING RATES THEREFOR, PROVIDING PENAL2IES FOR VIOLATIONS, AND REPEALING ORDINANCE NO. 2582 AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. THE CITY OF EVERETT DOES ORDAIN: Section 1: There is hereby created in the Department of Public Works of the City of Everett a sub-department to be known as the Water Department. Section 2: The word "Superintendent" wherever used in this ordinance shall be held and construed to mean• the "Superin- tendent" of the Water Department of the City of Everett, and any act in this ordinance required or authorized to be done by the Superintendent may be done on behalf of the Superintendent by an authorized officer or employee of the Water Department. The word "Person" or "Customer" wherever used in this ordinance shall be held to mean and include persons of either sex, associations, co-partnerships, and corporations, whether acting by themselves or by a servant, agent or employee, the singular number shall be held and construed to include the plural and the masculine pronoun to include the feminine. Section 3: The Superintendent of the Water Department shall be a licensed Hydraulic Engineer of the State of Washington and shall be experienced in the managment and operation of water and hydraulic systems and shall have in his charge and under his control subject to the Commissioner of Public Works, the manage- ment, maintenance, and operation of the Water Department of the City of Everett including the Sultan River Water Supply System and all auxiliary pumping apparatus, reservoirs, pipes and of all persons employed thereon, and of all construction work undertaken by the City in connection with said water system. The official title of said Superintendent shall be Super- intendent of Everett Water Department. He shall be appointed by the Commissioner of Public Works and his appointment shall be confirmed by the City Council of Everett. He shall be the admin- istrative head of the Water Department with authority to employ and discharge employees of said department by and with the advice and consent of the Commissioner of Public Works of said City. Section 4: The salaries of officers and employees of the Water Department shall be fixed by the City Council of Everett, by ordinance, to conform with the departmental budget, as author- ized by the Council. Section 5: Overhead Charges: There shall be charged to the Water Department such sum per annum as the City Council may fix as a General Expense item, for reimbursement to the Department of Finance, Public Works, and Safety, and the Office of City Attorney for general supervision and additional work of said departments for the Water Department. Section 6: Accounts: The City Clerk shall keep the Water Accounts for the Water Department,
