The supplier's obligations to indemnify and save harmless the city under the terms of the purchase order <br />for the chemicals include without limitation that the supplier shall the supplier shall reimburse the City for <br />any damages or costs incurred from any foreign material or impurity. <br />2.3 SAFETY DATA SHEETS (SDS) <br />The Globally Harmonized System of Classification and Labeling of Chemicals (GHS) includes criteria for the <br />classification of health, physical, and environmental hazards, as well as specifying what information <br />should be included on labels of hazardous chemicals as well as SDS. <br />A copy of the most current SDS, complying with GHS criteria, must be submitted to the City of Everett <br />with the Supplier's bid submission, as well as with each shipment of chemicals. <br />2.4 REQUIRED AFFIDAVITS <br />Each delivery to the City must include affidavits stating that the supplied chemical meets the following: <br />• Applicable ANSI/AWWA standards. <br />• Standards of the Washington State Department of Health. <br />• National Sanitation Foundation (NSF) certification. <br />• Any additional specific requirements of the City. <br />2.5 SAMPLES AND ANALYSIS <br />The City reserves the right to retain samples from each shipment of chemicals. The Supplier agrees the <br />contents of the samples provided fairly represents the quality of the product delivered in that shipment. <br />The supplier will supply the City with the name of a local independent laboratory capable of performing <br />required analyses. Samples of each shipment of chemicals will be taken at receipt of deliveries. <br />The City of Everett reserves the right to have the samples from the chemical shipments tested by an <br />independent laboratory. Failure of a shipment to comply with the City specifications will be sufficient <br />reason for rejection of the shipment. Should a shipment be rejected, the Supplier shall remove all non- <br />conforming chemicals at its sole cost. Upon notice of rejection of a shipment, the Supplier shall furnish <br />another shipment immediately, which shall comply in all respects with the prescribed analysis. In the <br />event a Supplier is unable to promptly furnish the chemical of the acceptable quality, the City may obtain <br />the chemical elsewhere. <br />2.6 WATER POLLUTION CONTROL FACILITY DELIVERY INFORMATION <br />The Water Pollution Control Facility (WPCF) is located at 4027 4th Street SE, Everett, WA, 98201. All <br />deliveries are F.O.B. Destination. <br />The supplier must make deliveries within five (5) business days after receipt of an order during normal <br />business hours. The WPCF is open Monday through Friday, between 7:00 a.m. and 4:00 p.m. Deliveries <br />will not be accepted on weekends and holidays, nor outside the stated time period except by prior <br />agreement between the supplier and the City. <br />Supplier shall notify the WPCF at least twenty-four (24) hours in advance of actual expected delivery time. <br />Page 10 of 27 <br />
