A portion of Summit Avenue, lying between Blocks 595 and 594, Mitchell Land & <br />Improvement Co.'s First Addition to Everett, according to the Plat thereof <br />recorded in Volume 3 of Plats, Page 1, Snohomish County, Washington, <br />described as follows: <br />Beginning at the NE corner of Lot 20, Block 595 of said Plat; thence easterly to <br />the NW corner of Lot 19, Block 594 of said Plat; thence southerly to the SW <br />corner of Lot 11, Block 594 of said Plat; thence westerly to the SE corner of Lot <br />28, Block 595 of said Plat; thence northerly to the point of beginning. <br />AND <br />A portion of the east -west alley lying within Block 594, Mitchell Land & <br />Improvement Co.'s First Addition to Everett, according to the Plat thereof <br />recorded in Volume 3 of Plats, Page 1, Snohomish County, Washington, described <br />as follows: <br />Beginning at the SW corner of Lot 11, Block 594 of said Plat; thence easterly to the <br />SE corner of said Lot 11; thence south to a point on the northern line of Lot 6, <br />Block 594 of said Plat, said point lying directly south of the SE corner of Lot 11, <br />Block 594 of said Plat; thence westerly to the NW corner of Lot 10, Block 594 of <br />said Plat; thence northerly to the point of beginning. <br />be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. <br />Section 2: <br />That the City of Everett shall not be responsible nor liable for storm drainage runoff resulting <br />from existing drainage patterns as established on City rights -of -way that may currently, or in <br />the future, go over, under or across the above -described rights of way herein. <br />Section 3: <br />That this ordinance shall not become effective until the owners of the property abutting upon <br />the right of ways herein described have compensated the City of Everett in an amount equal to <br />one hundred percent of the current appraised value of the area herein described. The abutting <br />property owners shall have ninety (90) days following passage of this ordinance to exercise this <br />vacation. Unless otherwise amended by City Council, this ordinance shall be null and void if the <br />abutting property owner(s) fail to exercise this vacation within ninety (90) days following <br />passage of this ordinance. <br />2 <br />
