The on -site wetlands, stream, and associated buffers encumber the entirety <br />of the property. The applicant has requested reasonable economic use of the property and has <br />submitted an application to the City of Everett Planning Division to reduce the critical area buffer by <br />4,227 square feet to provide a building site for the single-family residence, setbacks, and small yard <br />area. To mitigate for these impacts the applicant will enhance the remainder of the on -site buffer areas <br />that consist of maintained lawn (11,616 square feet). A Critical Area Covenant will place 28,711 square <br />feet of the subject property under permanent protection. <br />AUTHORITY: Section 37.050.B.6(c) of the Critical Area Ordinance authorizes the Planning Director to <br />permit a reduction of critical area buffer only to the extent necessary to provide for a reasonable <br />economic use of the property. Where critical area buffer reduction is permitted, <br />enhancement/restoration of the buffer and/or critical area must be provided so that mitigation results <br />in no net loss of critical area and buffer functions to the maximum extent feasible. <br />FINDINGS: The Planning Director has found that the applicant has demonstrated that the proposed <br />development has met the requirements of EMC 19.37.050.6.6. as follows: <br />1) There is no other reasonable use or feasible alternative to the proposed development with less <br />impact on the critical area; and <br />2) The proposed development does not pose a threat to the public health, safety and welfare on or off <br />of the subject lot; and <br />3) Any alterations permitted subject to the requirements of this chapter shall be the minimum <br />necessary to allow for reasonable use of the property; and <br />4) The inability of the applicant to derive reasonable economic use of the property is not the result of <br />actions by the applicant in subdividing the property or adjusting a boundary line, thereby creating <br />the undevelopable condition after the effective date of the ordinance codified in this chapter; and <br />S) The proposal mitigates the impacts on the critical areas and buffers to the maximum extent possible. <br />j 2930 Wetmore Ave, Ste 8-A 425.257.8731 planning@everettwa.gov <br />Everett, WA 98201 425.257.8742 fax ` everettwa.gov r <br />
