1. INTRODUCTION <br /> 1.1. PURPOSE AND BACKGROUND <br /> The Washington State Department of Commerce, hereafter "COMMERCE," is initiating this Request <br /> for Proposals (RFP) to solicit proposals from law enforcement agencies, or consortia of law <br /> enforcement agencies, interested in participating in a project to procure less-than-lethal equipment for <br /> distribution to peace officers within their jurisdictions. <br /> COMMERCE intends to award multiple contracts to law enforcement agencies or consortia of law <br /> enforcement agencies across the state to procure and distribute less-than-lethal equipment as <br /> described in this RFP. <br /> 1.2. OBJECTIVES AND SCOPE OF WORK <br /> To enable the procurement and distribution of certain less than lethal equipment by law enforcement <br /> agencies that demonstrate need and a lack of access to less-than-lethal equipment due to the impact <br /> of RCW 10.116.040. <br /> . Any peace officer with access to less-than-lethal equipment purchased under this RFP shall receive <br /> training in the use of the equipment before the equipment is used by that peace officer. <br /> 1.3 MINIMUM QUALIFICATIONS <br /> Minimum qualifications include: <br /> • Law enforcement agency, or consortium of law enforcement agencies, operating under the <br /> laws of the state of Washington, and demonstrating need and a lack of access to less-than- <br /> lethal equipment due to the impact of RCW 10.116.040. <br /> • Eligible to receive grant funds passed to the Department of Commerce by the United States <br /> Department of Justice. <br /> 1.4 FUNDING <br /> COMMERCE has budgeted an amount not to exceed $1,000,000 for this project. <br /> COMMERCE intends to award multiple contracts to provide the services described within this RFP. <br /> Selected grantees will receive grants not to exceed $200,000 for the period of performance. <br /> Any contract awarded as a result of this procurement is contingent upon the availability of funding. <br /> 1.5 PERIOD OF PERFORMANCE <br /> The period of performance of any contract resulting from this RFP is tentatively scheduled to begin on <br /> or about November 15, 2021 and to end on June 30, 2022. Amendments extending the period of <br /> performance, if any, shall be at the sole discretion of COMMERCE. <br /> 1.6 DEFINITIONS <br /> Definitions for the purposes of this RFP include: <br /> Apparent Successful Contractor: The Applicant selected as the entity to perform the anticipated <br /> services, subject to completion of contract negotiations and execution of a written contract. <br /> Applicant: Law Enforcement Agency operating under the laws of the State of Washington <br /> interested in the RFP and which submits a proposal in order to attain a contract with the AGENCY. <br /> COMMERCE RFP No.19-31440-1 Page 4 of 18 <br />
