You are expected to attend this hearing. Code Enforcement Staff will present evidence <br /> to the Hearing Examiner, including photographs depicting the violation(s), this citation, <br /> other notices, property information, and a proposed order. The hearing is your <br /> opportunity to present evidence showing that either some or all of the violations did not <br /> occur or that they have already been corrected. You may bring witnesses, <br /> photographs, and documents to help you make your case. You may present your <br /> comments in writing and verbally. <br /> t <br /> 7. Agreed Order <br /> If the respondent is not a Repeat Violator (see Paragraph 1) and has completed the <br /> minimum corrective action described in this citation, he/she is eligible to enter into an <br /> - agreed order with the city. The agreed order means that the city agrees that it will not <br /> take further action against the respondent regarding the violations described in this <br /> citation as long as there are no further nuisance-related EMC violations for the two-year <br /> period following the date of the order. <br /> If the Respondent is eligible to enter into an agreed order with the city, and signs the I <br /> agreed order, the Respondent is no longer required to appear at the hearing set forth in <br /> Paragraph 6. The Code Officer listed below must be contacted to schedule an <br /> inspection of the property if the Respondent wishes to apply for an agreed order. <br /> NOTHING HEREIN RELIEVES RESPONDENTS FROM THEIR OBLIGATION TO <br /> COMPLY WITH ALL APPLICABLE CODES. <br /> 8. Hearing Examiner Order <br /> Following the hearing, the Violations Hearing Examiner will issue an order determining <br /> whether or not the violations occurred, even if you do not attend the hearing. The <br /> Hearing Examiner's Order typically: <br /> i <br /> A. Determines whether the violations alleged in this citation did occur; <br /> B. Requires that the violations be corrected by a specific date; <br /> C. Imposes a monetary penalty in accordance with Chapter 1.20 EMC (typically <br /> $500 per violation); and <br /> D. Authorizes the City to enter the property, correct the violations, and to I <br /> assess the costs of the corrections, as permitted by law. <br /> 1 <br /> The City will make the Proposed Order available to the Respondent one business day <br /> prior to the hearing. To obtain a copy of the proposed order and other exhibits please <br /> contact the undersigned Code Enforcement Officer at least two business days before <br /> the hearing to allow for copying.
