Witness Chism submitted that the proposed facility will significantly impact the <br />Lowell neighborhood which is being specifically designated for this type of <br />a,Aivity. She contended that the City should impose a moratorium on such <br />facilities and look at the accumulative impacts. She indicated that the Lowell <br />neighborhood has attempteL: to improve the area, and this proposal is in conflict <br />with the neighborhood preservation. (Hoverter testimony, Chism testimony) <br />Jur."sdiction: The Hearing Examiner of the City of Everett has jurisdictional authority to <br />hold a hearing and to issue the decision. That authority is set forth in EMC 2.23.120. <br />Based on the above Findincs of Fact, the Hearing Examiner enters the following <br />Conclusio,is: <br />CONCLUSIONS <br />The Applicant requested approval of a Special Property Use Permit for the <br />installation of an above ground communications facility on property at 2117 <br />Lincoln Street, Everett, Washington. Because the subject property is in a single- <br />family residential zone, a Special Property Use Permit has to be obta ned for the <br />proposed facility. (finding 1) <br />The proposed project involves the replacement of an existing 78-foot high <br />SnoPUD pole with a 105-foot high pole. In addition, there will be two panel <br />antennas at the to-) of the pole which will be circuited with three conduit lines to a <br />114 square foot equipment building located on the site. The equipment building <br />will house up to four cabinets. (finding 2) <br />3. In order for a Special Property Use Permit to be granted, the General Evaluation <br />criteria as listed in finding of fact #5 must be satisfied. The subsections of this <br />ordinance have been addressed and are satisfied.
