DocuSign Envelope ID:704E0E30-EC1C-4FAA-8969-49FCE6E1A74E <br /> and describes types of activities,such as legislative liaison activities and professional and technical services that are not <br /> subject to this prohibition. <br /> Therefore,any costs associated with lobbying activities must be recorded separately in a grantee's books to ensure that <br /> they are not charged to this grant. <br /> Humanities Washington and the National Endowment for the Humanities are required by the provisions of its <br /> appropriations act to include the text of 18 U.S.C.1913 in all of its award,cooperative agreement,and contract <br /> documents. <br /> Text of 18 U.S.C.1913: <br /> No part of the money appropriated by any enactment of Congress shall,in the absence of express authorization by <br /> Congress,be used directly or indirectly to pay for any personal service,advertisement,telegram,telephone,letter,printed <br /> or written matter,or other device,intended or designed to influence in any manner a Member of Congress,a jurisdiction, <br /> or an official of any government,to favor,adopt,or oppose,by vote or otherwise,any legislation,law,ratification,policy, <br /> or appropriation,whether before or after the introduction of any bill,measure,or resolution proposing such legislation, <br /> law,ratification,policy,or appropriation;but this shall not prevent officers or employees of the United States or of its <br /> departments or agencies from communicating to any such Member or official,at his request,or to Congress or such <br /> official,through the proper official channels,requests for any legislation,law,ratification,policy,or appropriations which <br /> they deem necessary for the efficient conduct of the public business,or from making any communication whose <br /> prohibition by this section might,in the opinion of the Attorney General,violate the Constitution or interfere with the <br /> conduct of foreign policy,counter-intelligence,intelligence,or national security activities. Violations of this section shall <br /> constitute violations of section 1352(a)of title 31. <br /> 9. Procurement Standards(2 CFR§§200.317—326) <br /> Grantee is subject to the procurement standards set forth in 2 CFR§§200.317—326. Also see Appendix II to 2 CFR part <br /> 200—Contract Provisions for Non-Federal Entity Contracts Under Federal Awards. <br /> The standards contained in this section do not relieve the grantee of the responsibilities arising under its contracts. The <br /> grantee is the responsible authority,without recourse to Humanities Washington or the National Endowment for the <br /> Humanities,regarding the settlement and satisfaction of all contractual and administrative issues arising out of <br /> procurements entered into in support of an award or other agreement. Matters concerning the violation of a statute are <br /> to be referred to such Federal,state,or local authority as may have proper jurisdiction. <br /> 10. Audit Requirements <br /> Humanities Washington may inspect or audit grantee's financial accounts and records or may assign a qualified person to <br /> do so. Inspection and audit may include visits to the grantee before grant payments are made to make sure that the <br /> grantee's accounting system is adequate. The National Endowment for the Humanities may also conduct an inspection or <br /> audit. The Federal Government has the right to audit third party accounts related to the grants. <br /> If required,grantee shall have audits performed that meet the requirements of the Single Audit Act Amendments of 1996 <br /> (31 USC 7501-7507)as implemented by 2 CFR 200,Subpart F-Audit Requirements. Grantees that expend more than <br /> $750,000 in Federal funds from all sources during their fiscal year are subject to the Single Audit(formerly known as <br /> the A-133 audit). <br /> If applicable,this grant provided by Humanities Washington must be identified as such on the schedule of expenditures of <br /> federal awards(SEFA). <br /> This grant provided by Humanities Washington is a re-grant of money received from the National Endowment for the <br /> Humanities,a Federal agency. This means that the funds awarded through this grant are Federal funds(45.129 <br /> Promotion of the Humanities Federal-State Partnership)and that grantee must comply with any Federal,state,or local <br /> laws,rules,or regulations that may pertain. <br /> 11. Misapplied Funds <br /> If Humanities Washington determines that grantee has misapplied any of the grant funds,Humanities Washington has an <br /> ownership interest in any money or property acquired through the use of the misapplied funds. Grantee must also repay <br /> misapplied funds to Humanities Washington. <br /> 8 <br />
