contained in this ordinance, after the Planning Commission's consideration; and <br /> I. The proposal has been properly noticed and evaluated consistent with state law and city code; and <br /> J. City staff reviewed the proposal under provisions of the State Environmental Policy Act, completed <br /> an environmental checklist, and issued a Determination of Non-Significance on October 18, 2021; <br /> and <br /> K. Notice of the proposed amendments to the comprehensive plan map and building height codified <br /> map was sent to the Washington State Department of Commerce on October 19, 2021; and <br /> L. The public health, safety and welfare will be provided for by these map amendments; and <br /> M. The proposed map amendments promote the best long-term interest of the Everett community; <br /> and <br /> N. The proposed map amendments were considered as part of the 2021 annual docket of <br /> comprehensive plan amendments including consideration of potential cumulative impacts. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN THE FOLLOWING ACTIONS: <br /> Section 1. Amend the City of Everett Comprehensive Plan Land Use Map to remove the Resource Lands <br /> designation from the portions of the Smith Island West annexation waterward of the ordinary high <br /> water mark, as indicated in Exhibit 1. <br /> Section 2. Amend the Maximum Building Heights Map in EMC 19.22.150 to affix a 7 floor maximum <br /> height on the portions of the Smith Island West annexation landward of the ordinary high water mark, <br /> as indicated in Exhibit 2. <br /> Section 3. Effective Date.This ordinance shall be effective January 1, 2022. <br /> Section 4. The City Clerk and the codifiers of this Ordinance are authorized to make necessary <br /> corrections to this Ordinance including, but not limited to,the correction of scrivener's/clerical errors, <br /> references and ordinance numbering. <br /> Section 5. The City Council hereby declares that should any section, paragraph, sentence, clause or <br /> phrase of this ordinance be declared invalid for any reason, it is the intent of the City Council that it <br /> would have passed all portions of this Ordinance independent of the elimination of any such portion as <br /> may be declared invalid. <br /> Section 6. The enactment of this Ordinance shall not affect any case, proceeding, appeal or other <br /> matter currently pending in any court or in any way modify any right or liability, civil or criminal,which <br /> may be in existence on the effective date of this Ordinance. <br /> mil <br /> 16.
