CITY OF EVERETT <br />Community, Planning & Economic Development Department <br />Planning Division <br />PLANNING DIRECTOR DECISION <br />FILE NUMBER: Rev II 18-020 <br />APPLICANT: Adam & Fabriece Casper <br />4817 Bayview Lane <br />Everett, WA 98203 <br />ADDRESS: 4817 Bayview Lane <br />ZONING: R-S: suburban residential <br />PROJECT DESCRIPTION: Correction of a grading violation on a slope above Narbeck Creek in response <br />to a Notice to Comply (CE 18-0576) issued by the city on July 2, 2018. <br />FINDINGS: The subject site is developed with a single family dwelling unit with attached garage built in <br />1985 on the western half of the lot. The eastern half of the lot has slopes greater than 33 percent with <br />medium to high risk of erosion and medium to very high risk of landslide. The slopes on -site are part of <br />the western bank of Narbeck Creek, a Type NP classified stream. <br />On July 2, 2018, the Code Enforcement Unit of the Everett Police Department issued a Notice to Comply, <br />CE 18-0576, after an inspection of the subject site revealed unauthorized alteration of the critical areas <br />and buffers. A portion of the property extending east of the driveway into the critical areas and buffers <br />had been altered with land fill, tree removal, and grading. <br />A land use application for the correction of the critical area violations was submitted to the Community, <br />Planning, & Economic Development Department on October 17, 2018. Public notice of the application <br />was mailed December 6, 2018 and the site was posted December 9, 2018. No formal comments from <br />the public were submitted. <br />Everett Municipal Code (EMC) 19.37.250.13.2 grants authority to the planning director to require <br />restoration of the unauthorized area of alteration to a condition which is equivalent or superior to its <br />prior natural condition, to the extent that such condition can be determined. Per EMC 19.37.260.1), <br />restoration shall include, but not be limited to, the replacement of all improperly removed ground cover <br />with species similar to those which were removed or other approved species such that the biological <br />and habitat values will be replaced, improper fill removed and slope stabilized. <br />EMC 19.37.220.A requires all features classified as critical areas and their buffers to be placed in a <br />critical area protective covenant. <br />2930 Wetmore Ave, Ste 8-A © 425.257.8731 O planning@everettwa.gov <br />Everett, WA 98201 425.257.8742 fax everettwa.gov <br />
