EVERETT <br /> WASHINGTON <br /> LITTLE LEAGUE <br /> �/ <br /> AGREEMENT <br /> THIS AGREEMENT, entered into as of, Afal4 (q , 2021 between the City of Everett, hereinafter called <br /> the "City," and Everett Little League, hereinafter called the "Association" is as follows: <br /> 1. PURPOSE <br /> The purpose of this Agreement is to establish an understanding and working relationship regarding the Little <br /> League Program in the city of Everett. Further, this Agreement is intended to codify a working understanding <br /> regarding fees, scheduling, use of fields, maintenance, concessions and other issues associated with a little <br /> league program for the Everett youth and public in general in the city of Everett. <br /> 2. TERM <br /> The term of this Agreement shall be from January 1, 2022 through December 31, 2023. <br /> 3. FACILITIES <br /> a) The City will provide ball fields on the dates and times as listed in Exhibit A (SCHEDULE OF FIELD <br /> USE). The Association will abide by any restrictions listed in Exhibit A (SCHEDULE OF FIELD USE) <br /> for a particular field. <br /> b) The City will be responsible for initial pre-season field preparation for all fields as listed in Exhibit A <br /> (SCHEDULE OF FIELD USE). This pre-season work will be accomplished by March 1st of each year, <br /> contingent upon weather conditions. The City does not guarantee the condition of the fields and the <br /> Association accepts the fields in the condition they are in as of March 1 annually. <br /> c) The City may provide facilities on a space available basis for league meetings, scheduling and related <br /> league business upon request from an Association representative. The Association's use of such <br /> facilities shall be subject to the City's Facility Use Policies. There shall be no charge for the use of <br /> these facilities. <br /> d) The City will provide bases, base anchors, pitching rubbers and home plates for all fields listed in <br /> Exhibit A (SCHEDULE OF FIELD USE). Bases will be a break-away style acceptable to the City. <br /> These break-away bases shall be removed and stored securely by the league at the end of each <br /> day's use. If bases are lost, stolen or damaged, the Association will be responsible for the <br /> replacement cost of the bases. <br /> e) The City will provide portable mounds at Phil Johnson. The league will be responsible for transporting <br /> all portable mounds on and off the fields when in use. If the portable mounds are lost, stolen or <br /> damaged, the Association will be responsible for the replacement cost of the portable mounds. <br /> Proper transporting guidelines and instructions for portable mound use will be listed in Exhibit A <br /> (PORTABLE MOUNDS) <br /> f) The Association may provide its own locks and keys for Association owned and approved equipment <br /> boxes/sheds, provided the Association provides the City a key(s). The Association is not permitted to <br /> use its own locks on city gates or City owned buildings. <br /> g) The Association shall be responsible for the maintenance, repair and appearance of their equipment <br /> boxes, sheds and/or buildings and any signage to a standard determined solely by the City. This <br /> includes the removal of all graffiti within 24 hours of observation and proper storage of flammable <br /> containers. <br />
