` EVERETT <br /> WASHINGTON <br /> EXHIBIT D <br /> Concessions and Storage Facilities <br /> 1) The Association agrees to pay for and/or provide the following: <br /> a) Conduct all business related to the operation of the concession and comply with all applicable laws, <br /> rules and regulations, including, but not limited to Snohomish County Health Department and City <br /> and/or State licensing requirements. <br /> b) Provide a copy of a valid and current health permit as provided by the Snohomish County Health <br /> Department <br /> c) Assume all costs associated with the operation of the concessions, including, but not limited to, <br /> equipment, labor, supplies and utilities. <br /> d) Fire and casualty insurance covering the concession structure and contents shall be provided by the <br /> Association at the expense of the Association. The Association shall provide the City with a <br /> Certificate of Insurance naming the City, its officers, employees and agents as an additional insured <br /> on said policy, and agrees to provide the City with at least thirty days written notice of cancellation of <br /> said insurance. <br /> e) The Association understands and agrees that the concession facility at the Garfield Park and the <br /> storage facilities at the Legion Park Ballfields and all appurtenances are the sole property of the City. <br /> Any structural change in the facility or appurtenances must be approved by the City. <br /> f) The Association will store all gas cans and other flammable material appropriately and in certified <br /> containers. <br /> D1 <br />
