A sleeping room in the attic area fails to meet minimum requirements for use as habitable <br /> space due to the lack of compliant emergency escape opening and the lack of minimum <br /> occupancy dimensions,which are violations of IPMC 404.4, and IPMC 404.4.5. The record <br /> demonstrates said City ordinances were violated. <br /> 4. The attic room lacks suitable means of egress to be used as occupied space and is a violation <br /> of IPMC 702.1. The record demonstrates said City ordinance was violated. <br /> 5. The violating conditions can be considered three separate actions in violation of applicable <br /> codes: allowing habitation of the unpermitted third floor attic rooms,provision of rooms for <br /> rent without Code-compliant egress route, and improper maintenance of exterior surfaces, <br /> for a total of three violations. <br /> 6. Owners of property are considered responsible for correcting violating conditions even when <br /> those violations began under previous ownership. At EMC I.20.020.A,the municipal code <br /> states(in pertinent part): No person owning, leasing,renting,occupying or having charge or <br /> possession of any property in the city,including vacant lots, shall maintain or allow to be <br /> maintained on any such property a violation of any of the [regulations identified in that code <br /> section,which include the City of Everett Building Code]. <br /> ORDER <br /> Based on the findings of fact and conclusions of law stated above, it is hereby concluded that the <br /> Respondents allowed violation of IPMC 106,1, IPMC 304.1.1(4), IPMC 404.4.4,IPMC 404.4.5, <br /> and IPMC 702.1 on the subject property and is hereby ordered as follows: <br /> 1. The Respondents must abate all violations of IPMC 106.1, IPMC 304.1.1(4), IPMC 404.4.4, <br /> IPMC 404.4.5, and IPMC 702.1 on property located at 2730 Pine Street,Everett, <br /> Washington. <br /> 2. Abatement shall include the folio <br /> a. The attic level shall be vacated by April 20,2021 and remain vacant until and unless it <br /> is approved for occu ancy by the City of Everett Building Division. <br /> b. The Respondents shall apply for and obtain all of the necessary and required permits to <br /> bring the property into compliance with City ordinances.
