For the purpose of this code, any structure or premises that has any or all of the conditions
<br /> or defects described below shall be considered dangerous:

<br /> (2) The walking surface of any aisle,passageway, stairway, exit, or other means of egress
<br /> is so warped, worn loose, torn or otherwise unsafe as to not provide safe and adequate
<br /> means of egress..

<br /> (5) The building or structure, or part of the building or structure, because of dilapidation,
<br /> deteriorations, decay,faulty construction, the removal or movement of some portion of
<br /> the ground necessary for the support, or for any other reason, is likely to partially or
<br /> completely collapse, or some portion of the foundation or underpinning of the building
<br /> or structure is likely to fail or give way..

<br /> 5. IBC 105.1 Permit required,which reads:
<br /> Any owner or authorized agent who intends to construct, enlarge, alter, repair, move,
<br /> demolish or change the occupancy of a building or structure, or to erect, install, enlarge,
<br /> alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing
<br /> system, the installation of which is regulated by this code, or cause any such work to be
<br /> done, shall first make application to the building official and obtain the required permit.
<br /> 6. IBC 113.1 Unlawful Acts,which reads:
<br /> It shall be unlawful for any person,firm or corporation to erect, construct, alter, extend,
<br /> repair, move, remove, demolish or occupy any building, structure or equipment regulated by
<br /> this code, or cause same to be done, in conflict with or in violation of any of the provisions
<br /> of this code.
<br /> Conclusions of Law Based on Above Findings:
<br /> 1. Construction activity conducted on property within the City of Everett without required City
<br /> permits is a violation of IBC 105.1 and IBC 113.1. The record demonstrates said City
<br /> ordinances were violated.
<br /> 2. The condition of the structure's electrical equipment and deteriorated condition of the
<br /> structure's envelope rendered the structure's equipment unsafe and the structure dangerous
<br /> as defined by IPMC 108.1,IPMC 108.1.2 and IPMC 108.1.5 (2,5),in violation of IPMC
<br /> 106.1. The record demonstrates said City ordinance was violated.
<br /> ORDER
<br /> Based on the findings of fact and conclusions of law stated above, it is hereby concluded that the
<br /> Respondent allowed violation of IPMC 106.1,IBC 105.1,and IBC 113.1 on the subject property
<br /> and is hereby ordered as follows:
<br /> 1. The Respondent must abate all violations of IPMC 106.1,IBC 105.1,and IBC 113.1 on
<br /> property located at 3130 Broadway,Everett,Washington.
