(G) Vehicle parts or other articles of personal property which are discarded or left in a state <br />of partial construction or repair; <br />Supporting Applicable Law <br />1. IPMC 108.1.4 Unlawful Structure, which reads: <br />An unlars ful structure is one found in whole or in part to be occupied by more persons than <br />permitted under this code, or was erected, altered or occupied contrary to law. <br />Conclusions of Law Based on Above Findings: <br />1. The unpermitted alterations and creation of a dwelling unit in the basement of the single- <br />family residential structure renders the structure as unlawful as defined by IPMC 108.1.4 <br />and is a violation of IPMC 106.1. The record demonstrates said City ordinance was <br />violated. <br />2. Unpermitted construction alterations on a property within the City of Everett without <br />required City permits is a violation of IRC R105.1. The record demonstrates said City <br />ordinance was violated. <br />3. The presence of uncontained garbage that is not being stored in an approved covered <br />container on the property is a violation of IPMC 308.1. The record demonstrates said City <br />ordinances were violated. <br />4. Discarded bagged garbage, junk, cans, broken furniture, and items of personal property in <br />public view on the subject property are violations of EMC 8.20.020 (A) (C) and (G) and are <br />public nuisances. The record demonstrates said City ordinances were violated. <br />ORDER <br />Based on the findings of fact and conclusions of law stated above, it is hereby determined that <br />the Respondents allowed violation of IPMC 106.1 IPMC 308.1, IRC R105.1, and EMC 8.20.020 <br />(A) (C) and (G) on the subject property and are hereby ordered to: <br />1. The Respondents must abate all violations of IPMC 106.1 IPMC 308.1, IRC R105.1, and <br />EMC 8.20.020 (A) (C) and (G) on property located at 6214 Broadway, Everett, Washington. <br />2. Abatement shall include the following: <br />a. The basement dwelling unit must immediately be vacated and secured from entry and <br />remain vacant until and if occupancy is approved by the City of Everett Building <br />Division. <br />b. The Respondents shall either properly store in an enclosed area or remove and properly <br />dispose of all discarded items in public view on the subject property by January 10, <br />2020. <br />
