(Testimony of Code <br />Enforcement Officer Cunningham) <br />Based on the above findings of fact, the Violations Hearing Examiner enters the following <br />conclusions: <br />CONCLUSIONS OF LAW <br />Jurisdiction: <br />Pursuant to EMC Chapter 1.20 or any Everett Municipal Code provisions that identify EMC <br />Chapter 1.20 for enforcement, the Violations Hearing Examiner of the City of Everett has <br />jurisdictional authority to hold this hearing and to issue the decision. EMC 1.20.020. <br />Applicable Law: <br />1. IPMC 106.1 Unlawful Acts, which reads: <br />It shall be unlai4fail far a person, fain or coil3oration to be in conflict ivith or in violation of <br />any of the provisions of this code. <br />2. IPMC 308.1 Accumulation of rubbish or garbage, which reads: <br />All exterior property and premises, and the interior of every structure, shall be free from <br />accumulation of rubbish or garbage. <br />3. IRC R105.1 Permit Required, which reads: <br />Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, <br />demolish or change the occupancy of a building or structure, or to erect, install, enlarge, <br />alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing <br />system, the installation of which is regulated by this code, or to cause any such n,ork to be <br />done, shall first make application to the building official and obtain the required permit. <br />4. EMC 8.20.020 (A) (C) and (G) Nuisances — Residential property and nonresidential <br />property, which reads: <br />Except as authorized by subsection H of this section or as may be allowed by another city <br />ordinance, no person oivning, leasing, renting, occupying or having charge or possession of <br />any property in the city, including vacant lots, shall maintain or allow to be maintained on <br />the properly outside of a fully enclosed structure such cis a ,shed, dwelling, or closeable <br />garage, any of the following conditions visible fr•oin any street, alley, or other public or <br />private property: <br />(A) Junk, trash, litter, boxes, discarded lumber, salvage materials or other similar <br />materials; <br />(C) Broken or discarded f irniture, household equipment and f irnishings; <br />
