Violations & EMC Sections <br />Inspection of the property reveals the following conditions and violations: <br />An inspection of the property on December 22, 2019, revealed numerous bags of <br />garbage, and junk, cans, and damaged furniture were piled in the east yard area and <br />visible from the ROW. Dan Good was near the entrance leading into the basement and <br />said he had been waiting to be paid so he could haul the junk and garbage to the <br />dump. Good told me he lives in the lower unit and went into the basement to get his <br />phone. I could see a kitchen area (refrigerator and range) through the open door. <br />A search of City records revealed the basement structure was built in 1964 to support <br />the residence which was moved from another property. The permit history shows no <br />record of any finished space within the basement. Review of the Snohomish County Old <br />Assessor Record "Field Notes" indicated, on 11/26/1988 the inspector wrote, "... talked <br />to owner, BSMT Developed." This comment is likely why the Assessor indicates there is <br />800 sf of finished space in the basement despite the lack of City permits for the work. <br />A. The unpermitted alterations to the structure without required permits and approvals <br />are violations of International Residential Code (IRC) R105.1, which reads:_ <br />IRC RI05.1 Required. <br />Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br />move, demolish or change the occupancy of a building or structure, or to erect, <br />install, enlarge, alter, repair, remove, convert or replace any electrical, gas, <br />mechanical or plumbing system, the installation of which is regulated by this code, <br />or to cause any such work to be done, shall first make application to the building <br />official and obtain the required permit <br />B. The unpermitted alterations and creation of a new dwelling unit in the basement <br />render the structure Unlawful as defined by the International Property <br />Maintenance Code (IPMC) 108.1.4, in violation of IPMC 106.1, which read: <br />IPMC 108.1.4 Unlawful structure. <br />An unlawful structure is one found in whole or in part to be occupied by more <br />persons than permitted under this code, or was erected, altered or occupied <br />contrary to law. <br />IPMC 106.1 Unla wful acts. <br />it shall be unlawful for a person, firm or corporation to be in conflict with or in <br />violation of any of the provisions of this code. <br />Everett Police Departnmt, Code Enforcement Unit •3 02 Wetmore Ave - Everett, WA 98201 425-257-8560 <br />Pagel �/ / <br />
