110 41111 <br /> Rezone File #5-83 <br /> Dariotis Development, Inc. <br /> 7>4 <br /> THIS AGREEMENT made and entered this c2q' day of <br /> , 1984,, by and between the City of Everett, a municipal <br /> corporation under the laws of the State of Washington, hereinafter called <br /> "City," and Dariotis Developments, Inc., hereinafter called "Owner." <br /> WITNESSETH <br /> WHEREAS, the Owner has made application to the City to establish <br /> zoning on the parcel of property described in the Ordinance which is <br /> attached hereto and incorporated herein by reference; and <br /> WHEREAS, the Owner's proposed zoning and development would create a <br /> situation where a B-1, Neighborhood Business Zone would abut an R-3, <br /> Multiple Family Low Density Residential Zone; and <br /> WHEREAS, it is believed that the zoning of said area to permit <br /> Owner's development will be in the best interests of the citizens of <br /> Everett and, further, that the public health, safety, and welfare of the <br /> citizens of Everett would best be, served' by anticipating the impact of <br /> such development and imposing certain mutually agreed upon standards, <br /> conditions and requirements; .and <br /> WHEREAS, the Owner has agreed to develop, the aforementioned <br /> property per the condition stated herein in consideration of the City <br /> designating the property 8-1, Neighborhood Business; <br /> NOW, THEREFORE, it is mutually agreed as follows: <br /> Section 11. PERMITTED USES: <br /> All B-1 permitted uses shall be permitted on the subject property <br /> with a neighborhood business center to be located on the southern one-half <br /> of the subject property with multiple family uses to be located on the <br /> norther. one-half of the property. <br /> Section 2. SITE PLAN REVIEW: No permits will be issued can ths. <br /> site until a final site plan has been reviewed and approved by the City <br /> Planning and Public Works Departments in accordance with the c nd t O ,S t <br /> the rezone contract. <br />
