Based upon a review of record,the following fmdings of fact and conclusions of law hereby <br /> constitute the basis of the decision of the Everett Violations Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. Washington Flippers LLC (Respondent)is the owner of property at 844 Olympic Boulevard, <br /> Everett, Washington(subject property),which is in an R-2, Single-Family Medium Density <br /> Residential zone. Michael Snitko is the registered agent for Washington Flippers LLC. <br /> (Exhibit#9, Washington Secretary of Stated Business Information, dated September 30, <br /> 2019) (Exhibit#10, Snohomish County Assessor's Record with structural information, dated <br /> September 30, 2019) (Exhibit#11, Go Sync Map) <br /> 2. On November 8, 2018,ten months prior to the hearing date of the instant violation, an Order <br /> was issued by the Pro-Tem Everett Hearing Examiner concluding that the Respondent had <br /> violated ordinances of the City of Everett relating to unpermitted construction activity on a <br /> residential structure located in the City of Everett. Michael Snitko was present at the <br /> November 8,2018 hearing and received a copy of the Order. The Order required that the <br /> Respondent apply for and obtain all required City permits to bring the structure into <br /> compliance. The Respondent had not wholly complied with the requirements of the <br /> November 8,2018 Order. (Exhibit#5, Final Findings of Fact, Conclusions of Law, and <br /> Order of the Hearing Examiner Case #CE18-1075, dated November 8, 2018) (Testimony of <br /> Code Enforcement Officer Hinkley) gg <br /> 3. On August 6,2019, City of Everett Building Division Chief Inspector Ted de Budden <br /> conducted an inspection of the subject property. Chief Inspector de Budden observed and <br /> photographed the following conditions while standing at the front entry and on the driveway <br /> of the property: <br /> a. An elevated deck structure,approximately 16 feet X 20 feet,was being constructed on <br /> the front portion of the residential structure. <br /> b. New sliding glass doors had been installed to access the elevated deck. <br /> c. An exterior wall had been constructed on the carport to create a garage. <br /> d. Electrical wiring and electrical equipment had been installed within the carport/garage <br /> area and at various locations on exterior walls along the front portion of the structure. <br /> e. Gypsum board had been installed within the carport/garage area. <br /> f. Windows had been installed throughout the exterior of the residential structure. <br /> Chief Inspector de Budden heard active construction noises emanating from within the <br /> residential structure. Upon research of City records,Chief Inspector de Budden determined <br /> that the Respondent had not applied for or obtained the required City permits for the <br /> alterations being conducted on the residential structure rendering the structure as unlawful. <br /> A stop work order was posted on site.
