An unlawful structure is one found in whole or in part to be occupied by more persons than permitted under this code, or was erected, altered or occupied contrary to law. 3. EMC 1.20.010(E)Repeat Violator: "Repeat violator"means any person,firm, corporation, association, or agent thereof who has had any order issued pursuant to the provisions in this chapter, including any order 1 issued subsequent to a hearing, any stipulated order and any default order, and within twenty-four months of the issuance of such order commits or allows to be committed a new and separate violation of a same or similar chapter of the Everett Municipal Code that is enforceable under this chapter, regardless of location. Conclusions of Law Based on Above Findings: 1. The unpermitted alterations to the residential structure renders the structure as unlawful as defined by IPMC 108.1.4 and are violations of IPMC 106.1. The record demonstrates said City ordinance was violated. 1 2. Unpermitted alterations conducted on a residential structure on a property within the City of Everett without required City permits are violations of IRC R105.1. The record demonstrates said City ordinances were violated. 3. In light of the November 8,2018 Order issued by the Pro-Tern Everett Hearing Examiner, the record provided shows that the Respondent meets the definition of a repeat violator of . EMC 8.20.020 (E). 4. The date,time, and place of this hearing were provided in the violation citation. The Respondent received proper notice of this matter. The Respondent failed to appear at this hearing and has not stipulated with the City to any other resolution of this matter. Therefore,the Respondent is in default. ORDER Based on the findings of fact and conclusions of law stated above,it is hereby determined that the Respondent is in default and allowed violation of IPMC 106.1 and IRC R105.1 on the subject property and is hereby ordered to: 1. The Respondent must abate all violations of IPMC 106.1 and IRC R105.1 on property located at 844 Olympic Boulevard,Everett,Washington. 2. Abatement shall include the following: a. The residential structure located on the subject property shall remain vacant and secured from trespass until occupancy is approved by the City of Everett Building Division. b. The Respondent shall apply for and obtain all of the necessary and required permits to bring the property into compliance with City ordinances. The Respondent shall complete all of the required work and shall have the work inspected and approved by the City of Everett Building Division by April 24,2020. 5 1u
