An unlawful structure is one found in whole or in part to be occupied by more persons than <br /> permitted under this code, or was erected, altered or occupied contrary to law. <br /> 3. EMC 1.20.010(E)Repeat Violator: <br /> "Repeat violator"means any person,firm, corporation, association, or agent thereof who <br /> has had any order issued pursuant to the provisions in this chapter, including any order 1 <br /> issued subsequent to a hearing, any stipulated order and any default order, and within <br /> twenty-four months of the issuance of such order commits or allows to be committed a new <br /> and separate violation of a same or similar chapter of the Everett Municipal Code that is <br /> enforceable under this chapter, regardless of location. <br /> Conclusions of Law Based on Above Findings: <br /> 1. The unpermitted alterations to the residential structure renders the structure as unlawful as <br /> defined by IPMC 108.1.4 and are violations of IPMC 106.1. The record demonstrates said <br /> City ordinance was violated. <br /> 1 <br /> 2. Unpermitted alterations conducted on a residential structure on a property within the City of <br /> Everett without required City permits are violations of IRC R105.1. The record <br /> demonstrates said City ordinances were violated. <br /> 3. In light of the November 8,2018 Order issued by the Pro-Tern Everett Hearing Examiner, <br /> the record provided shows that the Respondent meets the definition of a repeat violator of . <br /> EMC 8.20.020 (E). <br /> 4. The date,time, and place of this hearing were provided in the violation citation. The <br /> Respondent received proper notice of this matter. The Respondent failed to appear at this <br /> hearing and has not stipulated with the City to any other resolution of this matter. <br /> Therefore,the Respondent is in default. <br /> ORDER <br /> Based on the findings of fact and conclusions of law stated above,it is hereby determined that <br /> the Respondent is in default and allowed violation of IPMC 106.1 and IRC R105.1 on the subject <br /> property and is hereby ordered to: <br /> 1. The Respondent must abate all violations of IPMC 106.1 and IRC R105.1 on property <br /> located at 844 Olympic Boulevard,Everett,Washington. <br /> 2. Abatement shall include the following: <br /> a. The residential structure located on the subject property shall remain vacant and secured <br /> from trespass until occupancy is approved by the City of Everett Building Division. <br /> b. The Respondent shall apply for and obtain all of the necessary and required permits to <br /> bring the property into compliance with City ordinances. The Respondent shall <br /> complete all of the required work and shall have the work inspected and approved by <br /> the City of Everett Building Division by April 24,2020. <br /> 5 <br /> 1u <br />
