10. The City provided the Respondent with an opportunity to correct the conditions that were in <br /> violation of sections of the EMC and provided notice of the date,time and place of this <br /> hearing. The Respondent failed to appear at the hearing. <br /> 11. Chief Inspector Ted de Budden,testified at the hearing that this matter was brought to his <br /> attention by the Code Unit. Some of the larger items in violation were the construction of a <br /> deck and the enclosure of the carport area, as well as significant electrical installations 1 <br /> without benefit of permit. By enclosing the carport, a fire safety condition was created. <br /> Chief Inspector de Budden stated that the Respondent continued to work on the property <br /> after the notice to stop work had been posted. He stated that he has had contact with the <br /> Respondent and that a construction permit had been applied for. It is his understanding that <br /> the property is now for sale. Chief Inspector de Budden stated that the Respondent has not <br /> applied for the necessary electrical permits or additional permits necessary to bring the <br /> property into compliance. (Testimony of Ted de Budden) <br /> 12. Officer Hinkley testified at the hearing that upon the issuance of a Hearing Examiners <br /> Order,a notice will be placed on the property title. (Testimony of Code Enforcement Officer <br /> Hinkley) <br /> Based on the above findings of fact,the Violations Hearing Examiner enters the following <br /> conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to EMC Chapter 1.20 or any Everett Municipal Code provisions that identify EMC <br /> Chapter 1.20 for enforcement,the Violations Hearing Examiner of the City of Everett has <br /> jurisdictional authority to hold this hearing and to issue the decision. EMC 1.20.020. <br /> Applicable Law: <br /> 1. IPMC 106.1 Unlawful Acts,which reads: <br /> It shall be unlawful for a person,firm or corporation to be in conflict with or in violation of <br /> any of the provisions of this code. <br /> 2.
