Here is our idea if everyone is on-board: <br /> Every violation of the Building Code is a criminal misdemeanor. Therefore, it is appropriate to apply for(and execute if <br /> application is granted) a criminal search warrant to search for evidence of unlawful construction work based on Ted's <br /> posting the property with a stop work order yesterday and Eileen and Brett's observance today of construction sounds <br /> emanating from the house today. The steps would include: <br /> 1. Brett, if willing would draft the search warrant application based on his observances today. <br /> 2. Meanwhile, I will gather the legal authority establishing building code violations as criminal misdemeanors <br /> and work following a posted stop work order as a building code violation. <br /> 3. Ted and Eileen can do short declarations. Ted's establishing when he observed work without permits and <br /> thereafter his posting of the property with stop work order based on the work without permits. Eileen can <br /> do a declaration describing her observation of the stop work order today concurrent with the construction <br /> noise coming from inside the structure. <br /> 4. Once the application, declarations,and supporting law are written/compiled, prosecutor's office will review <br /> the application and possible assist in presenting it to the judge (in case there are questions about the law as . <br /> it pertains to the building code). <br /> If this works for everyone we can get started. Assuming we are moving forward (and we can change course if this is not <br /> the case)-Ted and Eileen can you write me a paragraph or two about your involvement/observations(include dates)? I <br /> can format your statements into declarations.
