CITY OF EVERETT SPECIAL PROVISIONS I ' DIVISION 1 —GENERAL REQUIREMENTS Supplement Division 1 by adding the following: GENERAL DESCRIPTION AND LOCATION OF THE PROJECT (******) Work being performed includes, but is not limited to, furnishing all labor, materials and equipment necessary to construct approximately 2,270 linear feet of 42-inch combined sewer force main and 2,300 linear feet of 12-inch combined sewer force main and other such appurtenances, including trench excavation, haul, stockpiling and disposal, preparation of a project Health and Safety Plan with related submittals, and performing all Work as required by the Contract, in accordance with the Contract Documents. The Project is in Everett, Washington, and is generally located within a utility easement on Port of Everett property, Port of Everett Norton Terminal. This Project is located within the Port of Everett property and construction crosses portions of the Kimberly-Clark Worldwide MTCA Site and the ExxonMobil/ADC MTCA site, which are listed on the Washington State Department of Ecology's (ECY) Confirmed and Suspected Contaminated Sites List. Work on this project is subject to the Port of Everett site Soil and Groundwater Management Plans and the Temporary Construction License Agreement between the City of Everett and Port of Everett, which is provided in Appendix D. The Temporary Construction License Agreement is referred to as the "City-Port Agreement." The Contractor must be thoroughly familiar with and comply at all times with the City-Port Agreement. For example, the City-Port Agreement allows the Work on the Port of Everett property only in a defined License Area, and the City-Port Agreement expires on the City- Port Agreement Expiration Date (as defined in Section 1-01.3). The Contractor must complete all Work on Port of Everett property and achieve interim completion (as defined in Section 1-01.3) no later than the City-Port Agreement Expiration Date. Failure to achieve interim completion by that date may trigger Contractor payments to the City up to $10,000 per calendar day, as described in Section 1-08.9(1).
