The City Contractor shall coordinate with the Engineer, Port and POE-NT I Contractor for attendance at weekly construction meetings. e. The City Contractor shall coordinate activities with the Engineer and Port to provide the POE-NT Contractor with equipment crossing areas. This coordination shall include, as a minimum: i. Pipe construction is limited as detailed within the requirements of the City- Port Agreement. I ii. The POE-NT Contractor is accessing the site from Federal Avenue. Coordinate construction activities to accommodate access. The City Contractor is required to provide the POE-NT Contractor access as described within the City-Port Agreement. Unless otherwise stated within the City-Port Agreement, a minimum of a 50-foot wide access shall be provided. I iii. The City Contractor is required to coordinate and provide Temporary Erosion Control measures during pipe construction and until the construction area is backfilled and stabilized to the satisfaction of the Engineer. Storm water Management requirements shall be as provided in the City-Port Agreement and in accordance with the POE-NT GSWCP and SWPPP. iv. The Port of Everett will be storing and moving storage containers across the vicinity of Station 23+50 to the end of the City Project. The City Contractor is responsible to coordinate construction and stage his work in this area to provide the Port with the ability to move containers across the work limits. The storage containers may be located adjacent to both sides of the work zone. *** I Supplement Section 1-05 by adding the following new subsections: 1-05.16 Water and Power , (*****it) The Contractor shall make necessary arrangements and shall bear the costs for power and water necessary for the performance of the Work, unless the Contract includes power and water as a pay item. Contractor shall pay all power and water costs until Substantial Completion, whether such power or water is provided by temporary or permanent facilities. City shall not be liable for any costs or Delays arising out of or caused by the availability or lack of availability of permanent power or utilities. ***Water may be available from the City of Everett's Port Gardner Storage Facility." 1-05.17 Oral Agreements No oral agreement or conversation with any officer, agent, or employee of the City, either before or after execution of the Contract, shall affect or modify any of the terms or obligations contained in any of the documents comprising the Contract. Such oral agreement or conversation shall be considered as unofficial information and in no way binding upon the City, unless subsequently put in writing and signed by the City.
