The City Contractor shall coordinate with the Engineer, Port and POE-NT I <br /> Contractor for attendance at weekly construction meetings. <br /> e. The City Contractor shall coordinate activities with the Engineer and Port to provide <br /> the POE-NT Contractor with equipment crossing areas. This coordination shall <br /> include, as a minimum: <br /> i. Pipe construction is limited as detailed within the requirements of the City- <br /> Port Agreement. I <br /> ii. The POE-NT Contractor is accessing the site from Federal Avenue. <br /> Coordinate construction activities to accommodate access. The City <br /> Contractor is required to provide the POE-NT Contractor access as <br /> described within the City-Port Agreement. Unless otherwise stated within <br /> the City-Port Agreement, a minimum of a 50-foot wide access shall be <br /> provided. I <br /> iii. The City Contractor is required to coordinate and provide Temporary Erosion <br /> Control measures during pipe construction and until the construction area is <br /> backfilled and stabilized to the satisfaction of the Engineer. Storm water <br /> Management requirements shall be as provided in the City-Port Agreement <br /> and in accordance with the POE-NT GSWCP and SWPPP. <br /> iv. The Port of Everett will be storing and moving storage containers across the <br /> vicinity of Station 23+50 to the end of the City Project. The City Contractor <br /> is responsible to coordinate construction and stage his work in this area to <br /> provide the Port with the ability to move containers across the work limits. <br /> The storage containers may be located adjacent to both sides of the work <br /> zone. *** <br /> I <br /> Supplement Section 1-05 by adding the following new subsections: <br /> 1-05.16 Water and Power , <br /> (*****it) <br /> The Contractor shall make necessary arrangements and shall bear the costs for power and water <br /> necessary for the performance of the Work, unless the Contract includes power and water as a <br /> pay item. <br /> Contractor shall pay all power and water costs until Substantial Completion, whether such power <br /> or water is provided by temporary or permanent facilities. City shall not be liable for any costs or <br /> Delays arising out of or caused by the availability or lack of availability of permanent power or <br /> utilities. <br /> ***Water may be available from the City of Everett's Port Gardner Storage Facility." <br /> 1-05.17 Oral Agreements <br /> No oral agreement or conversation with any officer, agent, or employee of the City, either before <br /> or after execution of the Contract, shall affect or modify any of the terms or obligations contained <br /> in any of the documents comprising the Contract.
