I <br /> Section 00 21 13 <br /> INSTRUCTIONS TO BIDDERS <br /> 1.13 Award of Contract <br /> A. EVALUATION OF BIDS I <br /> Bids will be evaluated by the City to determine which bid is the lowest responsive bid by a <br /> responsible bidder and which bid, if any, should be accepted in the best interest of the City. <br /> The City, in its sole discretion, reserves the right to accept or reject any and all bids submitted111 <br /> and to waive informalities and minor irregularities. <br /> 1. LOWEST: The City will award the Project to the responsive and responsible bidder whose , <br /> Bid is the lowest. The Bid Form includes alternates. The City will determine at the City's <br /> sole discretion after Bid opening which alternates, if any,to include in the Work. The <br /> lowest Bid is the bid that has the lowest sum of base bid and the included alternates. I <br /> 2. RESPONSIVENESS: City will consider all the material submitted by the bidder to <br /> determine whether the offering is in compliance with the Contract Documents. The City <br /> reserves the right, at its discretion,to reject nonresponsive Bids. <br /> 3. RESPONSIBILITY: <br /> (a) Mandatory Responsibility Criteria: RCW 39.04.350(1). It is the intent of City to i <br /> award a contract to the lowest responsive and responsible Bidder. Before <br /> award,the Bidder must meet the Bidder responsibility criteria under this <br /> Section 1.13.A.3(a)to be considered a responsible Bidder. The Bidder may be <br /> required by the City to submit documentation demonstrating compliance with <br /> the criteria under this Section 1.13.A.3(a). The Bidder must: <br /> 1. Registration. Have a current certificate of registration as a contractor in <br /> compliance with chapter 18.27 RCW, which must have been in effect at the <br /> time of bid submittal;and111 <br /> 2. UBI. Have a current Washington Unified Business Identifier(UBI) number; <br /> and <br /> 3. State Requirements. If applicable: <br /> a. Have Industrial Insurance (workers' compensation)coverage for the <br /> bidder's employees working in Washington, as required in Title 51 RCW; <br /> b. Have a Washington Employment Security Department number, as 111 <br /> required in Title 50 RCW; <br /> c. Have a Washington Department of Revenue state excise tax registration <br /> number, as required in Title 82 RCW; and <br /> 4. Disqualification. Not be disqualified from bidding on any public works <br /> contract under RCW 39.06.010 or 39.12.065(3). <br /> 5. Apprentices. If the Project is subject to the apprenticeship utilization111 <br /> requirements in RCW 39.04.320, not have been found out of compliance by <br /> the Washington state apprenticeship and training council for working <br /> Rotary Park Renovation 4 of 11 <br /> I <br />
