(c) The City Project Manager shall release the portion of the License Area between City Stations 29+62 and 27+55 immediately upon the diligent and timely completion of the City Improvements within this portion of the License Area. (d) The City shall carefully remove and temporarily store the crushed rock of the cargo storage area(as identified on Exhibit C)that is within the City's area of disturbance. The City shall immediately replace and compact the cargo storage pad material in the condition in which it was found in conjunction with the City's backfilling activities within that area. Compaction of the material shall be in accordance with the specifications identified in Paragraph 13 of this exhibit. (e) The Port will endeavor to provide 48-hour notice in the event an immediate need to access the cargo storage pad emerges. The City and the Port will endeavor to identify an access route to accommodate the cargo and equipment transportation needs of the Port. If the Port's need to access the cargo storage pad requires the Port to use a portion of the License Area or the access roads provided under Section 6 below, and if such Port use causes the City to be unable to use the License Area or portion thereof, and the City's Contractor is unable to conduct planned work within such portion of the License Area due to the Port's use,then the resulting direct number of days that the City's Contractor's inability to work in such portion of the License Area delays Interim Completion of the Work shall be added to the Term of the Agreement. (f) The City Contractor shall not store materials in any way that blocks access to the cargo storage pad and the use of the southern access point to the Port Property. 5. Port Access Locations within the License Area: The City acknowledges that the Port has eight utility crossings within the License Area, as shown on Exhibit F (the"Crossings"). The Port and the City will closely coordinate the Port's use of the Crossings to reduce impacts to their respective contractors. The City will maintain a minimum of two of these Crossings as 50-ft wide access crossings across the License Area at mutually agreed locations for either necessary equipment and material crossings, or for necessary installation of the planned Port utilities; however, if the Port's use of the Crossings causes the City to be unable to use the License Area or portion thereof, and the City's Contractor is unable to conduct planned work within such portion of the License Area due to the Port's use,then the resulting direct number of days that the City's Contractor's inability to work in such portion of the License Area delays Interim Completion of the Work shall be added to the Term of the Agreement. Within these access crossings,the Port's Contractor shall maintain a minimum a 30-ft wide, south to north truck crossing at all times for the use by the City's Contractor. The Crossings, once established,will be marked with visible stakes and traffic will be controlled using a four-way stop intersection to reduce traffic conflicts. The City and the Port shall coordinate matters regarding the Crossings, during the weekly construction coordination meetings. 6. Northern Access of License Area and Truck Route: The Port will endeavor, for the benefit of the City, to provide an early truck route through the"preload panhandle" (i.e., the area of preload projecting to the east) of the Port's preload material, for the purpose Exhibit E 112558540.10 0073013-00041
