6. Hearing Date, Time & Location <br />Unless Respondent has entered into a stipulated agreement in accordance with <br />Section 7, a hearing before the Violations Hearing Examiner will be held on: <br />HEARING DATE: Thursday, October 26, 2017 at 1:00 p.m. <br />LOCATION: City of Everett Violations Hearing Room <br />Wall Street Building, Suite #8-C <br />2930 Wetmore Avenue <br />Everett, Washington 98201 <br />7. Agreed Order <br />If the respondent is not a Repeat Violator (see Section 1 of this Violation <br />Citation) and has completed the minimum corrective action described in this <br />citation, he/she is eligible to. enter into an agreed order with the city. The agreed <br />order means that the city agrees that it will not take further action against the <br />respondent regarding the violations described in this citation as long as there are <br />no further nuisance -related EMC violations for the two-year period following the <br />date of the order. <br />If the Respondent is eligible to enter into an agreed order with the city, and <br />signs the agreed order, the Respondent is no longer required to appear at the <br />hearing set forth in Paragraph 6. The Code Officer listed below must be <br />contacted to schedule an inspection of the property if the Respondent wishes to <br />apply for an agreed order. <br />NOTHING HEREIN RELIEVES RESPONDENTS FROM THEIR OBLIGATION TO <br />COMPLY WITH ALL APPLICABLE CODES. <br />8. Hearing Examiner <br />Following the hearing, the Violations Hearing Examiner may issue an order <br />against the Respondent, even if he/she does not attend the hearing. The <br />Hearing Examiners' Order may: <br />A. Require that the violations be corrected by a specific date; <br />B. Impose a monetary penalty in accordance with Chapter 1.20 EMC; <br />C. Authorize the City to enter the property, correct the violations and to <br />assess the costs of the corrections, as permitted by law. <br />The City will make the Proposed Order available to the Respondent one business day <br />prior to the hearing. To obtain a copy of the exhibits please contact the undersigned <br />Code Enforcement Officer at least two business days in advance to allow for the <br />preparation of the exhibits. Documents can be picked up at the Police Department <br />Records Unit counter located on the first floor at 3002 Wetmore Avenue.
