2/4/22,10:21 AM WestRock Construction Mail-Fw:Draft permit tracking#20-66051 Chris&Terrie Rae Anderson(Home Owners)-Everett,WA
contractor's actions has possibly damaged our relationship with BNSF. For that I am sorry.
I should note that Garin Schenk's email of Aug 5th did specify that the line was in place and requested
direction on how to proceed:
"We were able to get the Temporary Occupancy Permit(from the City of Everett) by providing a tightline from
a catch basin at the top of the bluff to the base, as shown on the site plan. That line is currently in place.
Given this information, please provide an instruction on how to best proceed."
I am sorry I was not able to give this my full attention during our son's illness. When I received the documents
outlining the BNSF requirements I honestly did not know how to proceed other than to try to do my best to
meet those requirements which I could.
Given all that, I need to ask what you would like us to do at this point? Do you want us to have WestRock pull
the line back off the BNSF ROW?This can be done without entering BNSF property. I should point out that
this will increase the possibility of slope erosion, increasing risk not only to our home but also to your tracks.
Is there any way we can proceed from here to the satisfaction of BNSF that will allow us to obtain permanent
occupancy for our home?
On a related question, are the Homeowner's,Auto and Umbrella policies I sent acceptable?
Thank you for your consideration.
Chris and Terrie Rae Anderson
On Thursday,September 16,2021, 12:16:29 PM PDT,Jon Gebow<jon@westrockcon.com>wrote:
Katie,
Yes, I had no choice but to install the drainage for a couple of reasons.
1.)The owners could not move into the house without the drainage being installed giving them occupancy from the City of Everett.
2.)The Architect had been working with BNSF for a very long time trying to get this agreement and had gotten very little feedback
from BNSF leaving all of us in a very tight position.Having to mitigate risk of erosion impacts to the hillside if we installed the
drainage.
On Thu,Sep 16,2021 at 12:02 PM Robles,Katie<Katie.Robles@am.jll.com>wrote:
Hi Jon,
Are you stating that you completed this work on BNSF ROW without an agreement?
On March 29,2021,BNSF is switching to an on-line application process with on-line credit card payments, and will no
longer accept paper applications or checks.
