Section 00 21 13 INSTRUCTIONS TO BIDDERS <br /> 1.16 EQUAL EMPLOYMENT OPPORTUNITY I <br /> A. The Contractor will be required to assure that equal employment opportunities <br /> will be in effect to all individuals throughout the length of this Contract, pursuant <br /> to Section 00 72 00, Part 7 "Labor Standards," of the Contract Documents. The <br /> Contractor must comply with all local, State and Federal laws pertaining to non- <br /> discrimination and equal employment opportunity. <br /> 1.17 DBE/WBE SUBCONTRACTOR REQUIREMENTS <br /> A. The Contractor is required to actively solicit bids for subcontract work from <br /> "Disadvantaged Business Enterprises" (DBE's) and "Women's Business <br /> Enterprises" (WBE's). The Contractor is required also to document such effort <br /> on the "City of Everett Disadvantaged/Women's Business Enterprise" form and to <br /> submit said form, in accordance with Section 00 45 39 of the Contract <br /> Documents, with its Bid. <br /> 1.18 NON-COLLUSION AFFIDAVIT I <br /> A. The Contractor must submit a "Non-Collusion Affidavit" in accordance with <br /> Section 00 45 19 of the Contract Documents as part of the Bid package. If the <br /> City has reason to believe that collusion exists among Bidders, the City will reject <br /> the Bids of the known participants in such collusion and may, at its option, <br /> require that all Bidders certify under penalty of perjury, that no collusion has <br /> occurred or exists. <br /> 1.19 STATE SALES TAX I <br /> A. The Washington State Department of Revenue has issued special rules on the <br /> State sales tax. The Contractor should contact the Washington State Department <br /> of Revenue for answers to questions in this area. The City will not adjust its <br /> payment if the Contractor bases a Bid on a misunderstood tax liability. <br /> B. The Contractor shall not include State retail sales taxes in the unit bid prices. A I <br /> separate line item for applying State retail sales tax is provided in the Bid Form. <br /> 1.20 LIMITATIONS REGARDING CONTRACTOR'S CLAIMS FOR DAMAGES <br /> A. Bidders should review the Contract Documents regarding limitations on claims <br /> for damages. I <br /> 1.21 DELAYS AND INTERFERENCE <br /> A. Bidders should review the Contract Documents regarding delays and 1 <br /> interference. <br /> 1.22 BIDDER'S CHECK LIST I <br /> A. The Bidder's attention is especially called to the following forms that must be <br /> executed in full as required and submitted with the Bid.
