5.1.14. implement procedures to prevent and detect the unauthorised alteration or replacement of POI <br /> devices in possession during deployment; <br /> 5.1.15. ensure that POI devices are physically secured or otherwise controlled to prevent unauthorised <br /> access,modification,or substitution while devices are deployed for use; <br /> 5.1.16. ensure that,POI devices maintain conformance with the corresponding Terminal Manufacturers <br /> Security Policy,including PIN shield installed,where deemed necessary for visual privacy. <br /> 5.1.17. prevent unauthorised physical access to devices undergoing repair or maintenance while in their <br /> possession. <br /> 5.1.18. complete regular inspection of the devices to prevent card information theft such as'card <br /> skimmers' (magstripe readers)and'card shimmers' (EMV Chip readers); <br /> 5.1.19. securely maintain POI devices being returned,replaced,or disposed of,and provide related <br /> instructions to third-party providers performing this service; <br /> 5.1.20. define and implement Card Scheme procedures for merchants on detecting and reporting tampered <br /> POI devices,including missing devices; <br /> 5.1.21. implement mechanisms to monitor and respond to suspicious activity on POI devices deployed at <br /> the Client location; <br /> 5.1.22. provide computer software,hardware and ancillary equipment reasonably specified by TNS which <br /> will effectively run the Services at the Client's site/s(or other such site/s nominated by the Client <br /> as the Client's site)and,where appropriate,access a Payment System; <br /> 5.1.23. monitor and reconcile their service and payments,notifying TNS within 45 days of the date of the <br /> suspected discrepancy; <br /> VARIATION OF SERVICES <br /> TNS may with prior written notice to the Client,change the Services in order to comply with any applicable safety, <br /> regulatory,security,PCI-DSS or statutory requirements otherwise in any way which does not have a <br /> material adverse effect on the Client's business operations or increase Client's fees set forth herein. <br /> TNS shall not be liable in respect of changes made to the provision of the Services where the Services are proprietary <br /> to a third party but TNS shall notify the Client promptly of any such changes as it becomes aware of them, <br /> and if requested by the Client shall facilitate and assist in any discussions between the Client and such third <br /> party in respect of such changes. <br /> If either party requests a change to the scope or execution of the Services,TNS shall,within a reasonable time,provide <br /> a written estimate to Client of; <br /> 5.1.24. The likely time required to implement the change; <br /> 5.1.25. any variations to the Transaction Fees arising from the change;and <br /> 5.1.26. any other impact of the change on the terms of this agreement. <br /> If either party request a change to the scope of the Services,the Client shall not unreasonably withhold or delay its <br /> consent to it; <br /> 17 <br />
