Commencing at the last mentioned "headblock" ; thence <br /> northerly along a No. 9 turnout to the left 80. 9 feet to <br /> the heel of frog and beginning of curve; thence continuing <br /> northerly along a 9 degree, 30 minute curve to the left <br /> a distance of 83. 5 feet to the end of curve; thence <br /> northerly and tangent 83. 7 feet to an intersection <br /> with the south line of that portion of Nassau Street <br /> vacated under Ordinance No. 3681, and the end of this <br /> description. <br /> EXCEPTING from above description the present right of way <br /> of the Great Northern Railway Company and the Northern <br /> Pacific Railway Company. <br /> Section 2. That wherever the said track crosses or is crossed <br /> by a street or avenue now constructed, or to be hereafter constructed, <br /> laid out or extended, said Grantee, its successors and assigns , shall <br /> plank and/or keep in repair all that portion of the improved street <br /> or avenue occupied by its tracks to the end of the ties on each side. <br /> Should the City of Everett pave or otherwise improve said street or <br /> avenue, the Grantee agrees that all portions of the street or avenue <br /> occupied by its track to the end of the ties on each side of said <br /> track shall be paved or improved by the Grantee. <br /> Section 3. Should the City desire to improve said street or <br /> avenue by the installation of pavement, water mains , or sewer lines , <br /> or other public utilities , the Grantee agrees to make such adjust- <br />` ments as are necessary to accommodate such public improvement. <br /> Section 4. The Grantee agrees that it shall immediately <br /> remove all locomotives and cars standing upon said tracks in said <br /> streets or avenues to permit the passage of emergency vehicles on <br /> emergency. <br /> The Grantee also agrees that it will erect such signs and <br /> signals as the City deems reasonably necessary to protect life and <br /> property. <br /> 2 <br />
