t , <br /> • <br /> • <br /> ORDINANCE NO. 3572 <br /> AN ORDINANCE REGULATING AND RESTRICTING TIC LOCATION AND USE OF BUILDINGS AND LAND <br /> WITHIN THE CITY OF EVERETT: LIIITING THE HEIGHTH OF BUILDINGS: PRESCRIBING BUILDING <br /> LINES AND SSIZE OF YARD AND OTHER OPEN SPACES: PROVIDING FOR TILL DIVISION OF THE CITY <br /> INTO USE ZONES; CREATING A BOARD OF ADJUST'IENT; AND PROVIDING FOR PENALTIES FOR VIO <br /> LATION OF THE ORDINANCE. <br /> SECTION 1. SHORT TITLE <br /> This ordinance shall be known as the Comprehensive Zoning Ordinance of the City of <br /> Everett. <br /> SECTION 2. PURPOSE AND SCOPE <br /> There is hereby established a comprehensive zoning plan for the City of Everett, which <br /> plan is set forth in the text, schedule, and nap that constitutes this Ordinance, and <br /> U:n .ch shall remain on file in the office of the City Clerk. The plan is adopted for <br /> tie purposes set forth in Section 7, Chapter 44 of the Laws of Washington for the year <br /> 1f13.5, and more particularly, for the public health, safety, morals, and general wel- <br /> l::... <br /> 11110,. The provisions of this Ordinance are designed to guide and regulate the future growth <br /> of Everett in accordance with a comprehensive land use plan ; to provide adequate <br /> lf.gh , privacy, air and convenience of access, to secure safety from fire and other <br /> dangers; to prevent overcrowding of land and to avoid undue concentration of popula- <br /> tion in order to lessen congestion in the streets; and facilitate adequate provision <br /> of transportation, water, sewerage, schools, parks and other public requirements. <br /> `.There this ordinance imposes a greater restriction upon the use of buildings or pre- <br /> :rises or upon the height of buildings or lot coverage, or requires greater lot areas, <br /> or larger yards, or other open spaces than are imposed or required by other existing <br /> provisions of law or ordinance or by other existing rules, regulations, or permits or <br /> by private restrictions, the provisions of this ordinance shall control. <br /> SECTION 3. DEFINITIONS <br /> 2or the purpose of this ordinance, certain terms and words are hereby defined. When <br /> not inconsistent with the context, words used in the present tense shall include the <br /> future; the singular number shall include the plural, and the plural the singular; <br /> and the word "shall" is mandatory and not merely per Missive. The definitions are as <br /> follows: <br /> ;;. GENERAL: <br /> 1. Amendment.
