(2) One track of standard gauge railway and a right <br /> of way therefor fifteen (15) feet in width, the <br /> center line of which right of way is described <br /> as follows : <br /> Beginning at a headblock in above mentioned yard <br /> track parallel to and at 56 feet centers with said <br /> main track opposite established main track station <br /> 194+0447.2, measured at right angles; thence south- <br /> westerly thru a No. 9 turnout, 81 feet to a heel <br /> of frog, making an angle of 6 degrees 22 minutes <br /> with said yard track; thence continuing south- <br /> westerly along a 13 degree curve to the left over, <br /> along and across said Norton Avenue and into the <br /> Port of Everett property. <br /> Section 3: That wherever said tracks cross the paved <br /> portion of Norton Avenue, said grantee shall resurface with asphaltic con- <br /> crete any portions of the existing paving which are disturbed in <br /> the construction of said tracks. Whenever the City of Everett shall <br /> decide by ordinance to replace, renew, or widen the existing paving <br /> at the location herein described, it shall be the duty of the grantee, <br /> its successors or assigns, to pave, at its own cost and expense, all <br /> the space lying between the outer rails of said tracks and for one (1) <br /> foot on the outside of each outer rail, to the full width of the <br /> paved portion of said Avenue, of 'such material, or in such manner as <br /> may be prescribed by said City, and under the direction and inspection <br /> of such persons as may be appointed by the City for that purpose; and <br /> such improvement shall thereafter be maintained in good repair at the <br /> expense of the grantee. <br /> Section 4: That wherever the said tracks cross or are to <br /> be crossed by a street or avenue now constructed or to be hereafter <br /> constructed, laid out or extended, said grantee agrees that in the <br /> event the City desires to improve said street or avenue by paving, <br /> installation of water mains or sewer lines, or other public utilities, <br /> it will make such adjustments as are necessary to accommodate said <br /> public improvement. <br /> Section 5: That the said grantee, its successors and <br /> assigns, will not allow its locomotives or cars to stand upon the <br /> track in Norton Avenue longer than ten minutes at any one time and in <br /> 2. <br />
