- _ <br /> A.) , <br /> .- <br /> . ... . <br /> Section 4: That Section 38 of Ordinance No. 2513 be, and <br /> it is hereby amended to read as follows: <br /> Section 38: No person, corporation, firm or associa- <br /> tion of persons shall place or cause to be placed, any <br /> stone, brick, timber, lumber, planks, boards, cement, <br /> lime, sand, gravel or other material or materials for <br /> building purposes of any kind or nature whatsoever in <br /> or upon any street, avenue, alley or other public ground <br /> in the City of Everett; no person, corporation, firm or <br /> associAtion of persons shall use any street, alley, <br /> avenue or other public ground in the City of Everett for <br /> the removal of any building without first having obtained <br /> a written permit and license therefor from the City <br /> Council of the City of Everett, and without executing a <br /> good and sufficient bond to be furnished by any surety <br /> company authorized to transact the business of a surety <br /> within the State of Washington, which bond shall be <br /> approved by the City Council, and in the case of placing <br /> or causing to be placed the above enumerated building <br /> materials in any street, avenue, alley or other public <br /> ground in the City of Everett shall be in the penal sum <br /> of One Thousand Dollars ($1000.00) and in case the <br /> applicant desires to use any street, avenue, alley or <br /> other public ground for the removal of any building <br /> such bond shall be in the penal sum of Ten Thousand <br /> Dollars ($10,000.00), and in either event shall be <br /> conditioned that said applicant for said permit and <br /> license will well and truly comply with all the re- <br /> strictions, conditions and limitations of said permit <br /> and license and will comply with all the provisions of <br /> the charter and ordinances of the City of Everett, both <br /> of those then in force and those which may thereafter <br /> be enacted, relating to the use of such places for <br /> building purposes and for the removal of buildings and <br /> further conditioned to save the City of Everett harmless <br /> from all claims, actions, demands and/or damages of <br /> every kind and description which may accrue to or be <br /> suffered by any person or persons by reason of the <br /> granting of said permit and license or by reason of <br /> negligent operations thereunder, and further conditioned <br /> that all sidewalks, street crossings, street pavement <br /> or other street improvement of any description shall <br /> be restored to as good condition as they were immed- <br /> iately prior to the granting of said permit and to the <br /> satisfaction of the City Council. <br /> The license fee for the removal of each building in, <br /> upon or along any of the above mentioned places shall <br /> 64 <br /> - be lasxoper day, or part thereof, for each and every <br /> 1,!') — day each building is upon any of the above mentioned <br /> places. <br /> —. ,-- <br /> -i--1 <br /> M a-y r <br /> Attest: <br /> L , <br /> City‘glerk / <br /> Passed: May 15, <br /> 1956 <br /> 11 <br /> Published: ti 16, 1956 <br />
