ORDINANCE NO. ??• <br /> AN ORDINANCE AMENDING SECTION 76 OF ORDINANCE NO. 3211 <br /> ENTITLED: <br /> AN ORDINANCE relating to and regulating traffic, travel, <br /> transportation and pedestrians and their incidents upon <br /> the streets, alleys and public ways of Everett, a mun- <br /> icipal corporation; prescribing the rules of road for <br /> vehicular, pedestrian and other traffic upon such streets, <br /> alleys and public ways; prescribing the powers and duties <br /> of the officers and other persons in relation thereto; <br /> defining offenses, providing penalties, adopting certain <br /> portions of the motor vehicle laws of the State of Wash- <br /> ington and existing amendments thereto; and repealing <br /> ordinance numbers 2318, 2734, 150, 2348, 2522 and 2612, <br /> all relating to traffic . <br /> AND DECLARING AN EMERGENCY TO EXIST, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Section 76 of Ordinance No. 3211 be, and <br /> it is hereby amended to read as follows : <br /> Section 76: SPEED REGULATIONS <br /> (a) Every person operating or driving a vehicle <br /> of any character shall operate the same in a careful and <br /> prudent manner and at a rate of speed no greater than is <br /> reasonable and proper under the conditions existing at <br /> the point of operation, taking into account the amount <br /> and character of the traffic, weight of vehicles, grade <br /> and width of highway, condition of surface and freedom <br /> of obstruction to view ahead and consistent with any and <br /> all conditions existing at the point of operation so as <br /> not to unduly or unreasonably endanger the life, limb, <br /> property or other rights of any person entitled to the <br /> use of such public highway. <br /> (b) Subject to the provisions of subdivision (a) <br /> of this section, and except in those instances where a <br /> lower maximum lawful speed is provided by this ordinance, <br /> or otherwise, it shall be unlawful for the operator of <br /> any vehicle to operate the same within the limits of this <br /> city at a speed in excess of the following: <br /> (1) Thirty-five (35) miles per hour upon those <br /> portions of the arterial highways described as follows : <br /> U. S. Highway No. 99, Primary State Highway #1, <br /> between the intersection of said highway and 45th Street <br /> and the south boundary of the City Limits of the City of <br /> Everett. <br /> U. S. Highway No. 99, Primary State Highway #1, <br /> between the intersection of the line of the North City <br /> Limits with the said highway to the intersection of said <br /> highway and 41st Street. <br />
