I . <br /> • <br /> .. <br /> Section 4: Each employee whose service is terminated <br /> will be allowed pay for any vacation earned in the preceding year and <br /> not taken prior to separation from City service, but no pay shall <br /> be allowed for vacation earned in the current year. Payment for a <br /> vacation may be made to an employee who, during any year, was not <br /> granted the vacation to which such employee was entitled, solely <br /> on account of the inability of the City to obtain a suitable relief , <br /> employee; provided, further, that before payment can be made for a <br /> vacation not actually taken, the City Council shall determine that <br /> such payment is necessary to prevent an injustice to the employee <br /> involved and shall, by resolution or ordinance, authorize such <br /> payment within thirty (30) days of the expiration of the year for <br /> which any such payment is made. No such payment shall be made to <br /> an employee who fails to request a vacation or fails to take his or <br /> her vacation at the time allotted by the department head. <br /> Section 5 : None of the provisions of this section shall <br /> apply to workmen engaged or working upon detached or independent <br /> pieces of construction work, temporary in character, of the class <br /> which may be done by contract to the lowest bidder or by day labor <br /> as provided by the City Charter where the City Council shall have <br /> determined that such work is prosecuted by day labor and authorized <br /> the employment of workmen thereon without the necessity of <br /> selection from the civil service eligibility list, except as herein <br /> otherwise provided. <br /> Section 6: All day laborers employed in any department <br /> 1 under provision of the budget of the City who shall have been <br /> 1 employed over six (6) months in the previous year shall be entitled <br /> to the benefits of this act. <br /> Section 7: That an emergency is hereby declared to <br /> exist and this ordinance shall take effect on January 1, 1956. <br /> Section 8: That Ordinance No. 3275 be, and it is hereby <br /> 1 <br /> superseded upon the effective date of this ordinance. <br /> • VA::'-'7-7411111111_ (741(Z:Je_ <br /> M d / o r <br /> Attest: <br /> City Clerk <br /> Passed: ?sec. 6, 1955 <br /> Published: Dec. 7, 1955 <br /> ik <br />
