• <br /> • • <br /> • <br /> ORDINANCE NO. <br /> AN ORDINANCE RELATING TO PHOTOGRAPHERS, THE BUSINESS <br /> OF PHOTOGRAPHY AND PHOTOGRAPHIC STUDIOS; PROVIDING FOR THE LICENSING <br /> AND REGULATION OF SUCH BUSINESS AND OCCUPATION; AND PROVIDING A <br /> PENALTY FOR THE VIOLATION THEREOF. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Definition of Terms <br /> The term `Photographer" as used herein, shall be held <br /> to include every person, firm or corporation engaged in the business <br /> of soliciting, taking, finishing and selling photographs, including <br /> all work and processes required to be done or used in reproducing <br /> from an exposed photographic film or plate, a positive image or <br /> likeness of the person (or object) of whom the exposure was taken, <br /> and of making one or more copies thereof, and of fixing, toning, <br /> retouching, washing and trimming the photograph and material upon <br /> which same is reproduced, or making reproductions or enlargements <br /> of finished photographs. <br /> The term "Photographic Studio" as used herein, shall be <br /> held to mean and include the business and the place of business of <br /> taking photographs for compensation. <br /> The terms "Goods, wares or merchandise", as used herein, <br /> shall be held to include photographs reproduced from an exposed <br /> photographic film or plate, and enlargements of photographs. <br /> Section 2: It sha' l be unlawful for any person, firm <br /> or corporation, to in any manner engage in the business of photo- <br /> graphy or act as a photographer, or operate or maintain a photo- <br /> graphic studio, or canvass, solicit for, or make photographs or <br /> photographic reproductions, without first obtaining from the City of <br /> Everett a license so to do. <br /> Section 3: Applications of a license shall be made in <br /> writing and be filed with the City Clerk. Each application shall <br /> be accompanied by a bond in the penal sum of $1,000.00 issued by a <br /> surety company authorized to do business in the State of Washington <br /> or by the deposit of a can bond in the sum of $1,000.00, conditioned <br /> that the applicant will faithfully comply with the conditions of <br /> this ordinance and the Laws of the State of Washington and guaran- <br /> teeing to any citizen of the City of Everett that all monies paid <br /> as a down payment will be accounted for and applied according to <br /> the representations of the licensee or its agents and property pur- <br /> chased will be delivered according to representations, conditioned <br /> further that action on the bond may be brought in the name of the <br /> City for the use or benefit of the agreed person. <br /> An application fee of Fifty ($50.00) Dollars shall be <br /> paid to said City Clerk by the applicant with each original <br /> application for a license, which sum is hereby fixed and determined <br /> as a reasonable and necessary expense to the City of Everett in the <br /> investigation of the reputation of the applicant for the faithful <br /> performance of all contracts entered into for the taking, fixing <br /> and sale of photographs and in the investigation of the character <br /> of the applicant. The Chief of Police of the City of Everett shall <br /> make said investigation for the City Clerk, and shall report the <br /> result of said investigation to the City Clerk within 30 days <br />
