• <br /> shall be deemed to be violated so as to permit of such for- <br /> feiture, unless the company shall first be given written notice <br /> of such violation or default, which notice shall state with <br /> particularity wherein such violation or default consists, and <br /> of the intent to declare a forfeiture, and thereafter if such <br /> violation or default shall continue for a period of more than <br /> sixty (60) days after the receipt by the company of such <br /> written notice, all of the rights and privileges had by the <br /> company under the provisions of this ordinance may be forth- <br /> with declared forfeited and revoked. <br /> Provided, however, that the company shall not be deemed to be <br /> in default for the performance of any provisions of this grant, <br /> nor shall any forfeiture be invoked for any violation of or <br /> failure to perform any provision hereof due to strikes, lock- <br /> outs, civil insurrection and disorder, acts of God, or any <br /> other causes beyond the control of the company. <br /> Section 15 Each section of this ordinance and each part of each section <br /> INVALIDITY <br /> hereof is hereby declared to be an independent section or a <br /> part of a section, and the holding of any section or part <br /> thereof to be unconstitutional, void, illegal, ineffective or <br /> contrary to the provisions of the Charter of the City of Everett <br /> or the amendments thereto, or the laws or Constitution of the <br /> State of Washington, for any reason, shall not affect any <br /> other section or part of this ordinance. <br /> Section 16 This ordinance is enacted and the grant herein provided for is <br /> CHARTER AND <br /> LAWS APPLI- made subject to all of the provisions of the Charter of the <br /> CABLE <br /> City of Everett and the laws of the State of Washington, and <br /> the company shall be bound by each and every provision of said <br /> Charter and of said laws in so far as the same may be appli- <br /> cable herein as though such provision was herein expressly <br /> written and made a part hereof. <br /> -7- <br />
