15. Existing Septic system layout to be provided by Owner,dimensions flagged on site to the best knowledge available from local municipalities,and/or the original Contractor who installed the existing Septic System(if available) and be noted on the Proposed Plan by Green Thumb Landscape Solutions prior to any design or construction. Green Thumb Landscape Solutions will take every precaution to avoid damaging the existing Septic System,but Green Thumb Landscape Solutions shall not be responsible for any damage to the existing Septic System that is not within the designated area. Repairs made to Septic System shall be by a licensed Septic System Contractor. 16. If Project Site access is limited to such an extent that warrants the use neighboring property(s) for Green Thumb Landscape Solutions to access Project Site,the Owner shall be the responsible for establishing an agreement with neighboring property owner(s) to allow access as minimally needed by Green Thumb Landscape Solutions onto the Project Site. Acceptance of this proposal homeowner warrants that such permission has been obtained. Green Thumb Landscape Solutions shall be responsible for all conduct of it's employees on the Project Site and the neighboring property(s). Any damage caused by Green Thumb Landscape Solutions in the neighboring property(s) shall be repaired and/or replaced to the existing conditions prior to access permission. 17. All Construction Permits(when applicable with the governing municipality)are to be obtained by the owner of the property unless requested for Green Landscape to obtain any permits. CONDITIONS/EXCLUSIONS CAN LIMIT THE WARRANTY AND CLARIFY SPOKEN UNDERSTANDINGS: 18. When applicable,the Owner is aware that it is difficult to grow lawn under evergreen trees. The Owner acknowledges that NO warranty is provided in this proposal for the lawn in those areas. When applicable,the Owner recognizes that a one-time herbicide application may not be adequate to prevent the return of the blackberries and other weeds and that a future weed control program will be necessary. CONDITIONS/EXCLUSIONS CAN RESERVE Green Thumb Landscape Solutions RIGHTS AND PRIVILEDGES: 19. Green Thumb Landscape Solutions has the right to substitute plant material if specific varieties are not available through its typical sources. Any plant material changes or substitutions shall be approved by the Owner. 20. Due to the fact that we purchase material on account,our supplier(s)may exercise their lien rights and send an intent to lien notice. The law that went into effect June of 1992 requires this. This notice in no way reflects our ability to pay our account or any credit concerns. 21. Termination. If this Agreement is terminated by any party,Customer agrees to pay Green Thumb Landscape Solutions for all time,materials,reimbursable expenses,and other applicable charges incurred to the date of termination. IRRIGATION and LIGHTING 22. Green Thumb Landscape Solutions shall provide and install all Irrigation Lighting sleeving as required per separate Irrigation Plan and Contract. This Proposal does not include any cutting,patching or removal of hard surfaces,or any boring beneath paved areas or through walls if required. 23. Home Owner to provide and install 110 v.power to and connection into automatic controllers,and provide outlet at location of each lighting transformer. WARRANTY: Green Thumb Landscape Solutions warranties all workmanship for one year and all new plant material for one year or one replacement.Transplanted material is not warranted. No warranty is provided for loss due to theft,vandalism,Owner neglect,irrigation failure or unusual weather conditions. The customer is responsible for all maintenance required to keep lawn and plant material healthy. These activities include watering,fertilizing,pruning and more. Failure to provide adequate maintenance nullifies this warranty. PAYMENT: Please choose payment type/s for your project: Cash/check • Permits/licenses are separate from contracts.Should a permit or a special license required by a local municipality be needed on any portion of the installation or the whole project,Green Thumb will procure the permit/license and bill clients the permit/license fees plus Administration Fees. A separate clause is entered into contract for the permit/license,should one be required. The prices, specifications and conditions stated herein are satisfactory and are hereby accepted. This signed contract is an authorization to do the work as specified. Payment will be made as outlined above. In the event that payment is not received upon completion,the balance due may be subject to a service charge.This proposal may be withdrawn by us if not accepted within 30 days.All material is guaranteed to be as specified.All work is to be completed In a workmanlike manner according to standard practices.Any alteration or deviation from the above specifications involving extra costs will be executed only upon written orders and will become an extra charge over and above this estimate.All agreements are contingent upon strikes,accidents or delays beyond our control. Owner to carry fire and other necessary insurance. Our workers are fully covered by workman's compensation insurance.
