,A ORDINANCE NO. 3270. An Ordinance providing for the improvement of Highland Avenue from 20th Street to the north line of Saint Nicholas Addi- tion to Everett; by constructing concrete sidewalks with an inte- gral curb; providing for the necessary surface drainage; and doing such other work as may be necessary in connection therewith, in accordance with a petition presented by the owners of seventy-five (750) per cent of the lineal frontage upon the improvement and seventy-five (75%) per cent of the owners of the area of the pro- perty within the improvement, requesting that the limitation of the assessment be raised to twice the assessed value to finance the improvement, creating a local improvement district fund there- for, and providing for the payment of said improvement by special assessment on the property in said district under the mode of pay- ment by bonds . WHEREAS, there has heretofore been filed with the City Council of -Lverett a petition for a local improvement as herein- after set forth, signed by seventy-five (75a) per cent of the owners of the area within the district ana by owners of seventy- five (75%) per cent of the lineal frontage upon said improvement, requesting that such limitation of assessment be raised to twice the assessed valuation, and WHEREAS, the said petition has been referred to the Com- missioner of Public Works to be examined by said Commissioner and City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, and WHEREAS, said Commissioner of Public 1vorks has recommend- ed to the city Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, conveniences, and necessity requires that such improvement be made, and the City Council having unanimously voted for the construction of said improvement as a public necessity, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That highland Avenue from 20th Street to the north line of Saint iicholas Addition to Everett be improved by constructing concrete sidewalks with an integral curb; providing for the necessary surface drainage; and doing such other work as may be necessary in connection therewith, all according to the plans and specifications prepared under the direction of the Oity Engineer, and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improve- ment, including all necessary incidental expense, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chap- ter 141, Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett.
