` EVERETT WASHINGTON USTA PACIFIC NORTHWEST AGREEMENT THIS AGREEMENT, entered into as of r((jl 1Z6 ZZ, between the City of Everett, hereinafter called the "City," and USTA Pacific Northwest, hereinafter called the "Tennis Program" is as follows: 1. PURPOSE The purpose of this Agreement is to establish an understanding and working relationship between the Tennis Program and the City. Further, this Agreement is intended to memorialize a working understanding for the provision of facilities for use by USTA Pacific Northwest as they relate to fees, scheduling, use of facilities, concessions and other issues associated with a recreational tennis program for youth and adults in the City. 2. TERM The term of this Agreement shall be from July 1, 2022 through December 315t, 2023. 3. FACILITIES a) The City will provide tennis courts (the "Tennis Courts")on the dates and times listed in Exhibit A (SCHEDULE OF TENNIS COURT USE)for program use. Exhibit A may be revised from time to time, with written approval of the Director of Parks and Community Services or his or her designee,to add, remove, or change the dates and time listed for the Tennis Program's schedule use of the Tennis Courts. The Tennis Program understands that such revisions may be subject to the approval of the Everett School District. The Tennis Program will abide by all rules and restrictions listed in Exhibit C (TENNIS COURT RULES AND REGULATIONS) and all rules of the Everett School District for each Tennis Court. b) The City will be responsible for securing the use of the Tennis Courts for the times listed in Exhibit A(SCHEDULE OF TENNIS COURT USE). If the City is unable to secure a Tennis Court for a scheduled time, it will notify the Tennis Program at least 48 hours prior to the scheduled event. The Tennis Program will be responsible for finding a suitable alternate location for the scheduled event. The City will cooperate with the Tennis Program in securing the use of an alternate tennis court so long as there is no additional expense to the City. c) The Tennis Program will provide all equipment for all events, games and other uses of the Tennis Courts under this Agreement, including,without limitation,tennis balls and rackets for all games, practices, or camps. d) The City may provide facilities (other than the Tennis Courts) on a space available basis for coaches' meetings, scheduling and other Tennis Program related business upon request from a designated Tennis Program representative. The Tennis Program's use of such facilities shall be subject to the City's Facility Use Policies. There shall be no charge for the use of these facilities. e) The City may provide storage space on a space available basis for Tennis Program equipment upon the request from a designated Tennis Program representative, but under no circumstances will such storage space be at the Tennis Courts listed in Exhibit A(SCHEDULE OF TENNIS COURT USE).
