f) The Tennis Program shall not allow any other agency,association,group, or tennis program to schedule or use a <br /> Tennis Court when the Tennis Program is scheduled to use that Tennis Court without express written consent by <br /> the City of Everett Parks and Community Services Department Director or his or her designee. <br /> g) The Tennis Program will designate one person to be the point of contact between the Tennis Program and the <br /> City. Such contact person will disseminate any information provided by the City and educate the Tennis <br /> Program, its employees,agents, contractors,youth, adults and spectators of the Tennis Program regarding such <br /> information. <br /> h) The City reserves the right to limit the amount of use, close or cancel any and all Tennis Court use. No <br /> modifications are allowed to any Tennis Court. If the Tennis Program, or any of its employees,agents, <br /> contractors, youth, adults and spectators violate the limitations placed on the Tennis Court use,the Tennis <br /> Program, its employees, agents, contractors, youth, adults and spectators may be prohibited from using a Tennis <br /> Court for the remainder of an event,the remainder of the camp,the following summer, or any other amount of <br /> time the City deems appropriate. <br /> 4. SCHEDULE <br /> The City shall identify the amount of time available at each Tennis Court in Exhibit A(SCHEDULE OF TENNIS COURT). The <br /> Tennis Program shall be solely responsible for and shall perform all scheduling of camps, events and Tennis Program <br /> related events and any service related to scheduling. The Tennis Program shall provide the City with a complete <br /> schedule of events for the term of this Agreement one-week prior to the first scheduled event. All schedule changes <br /> must be provided to the City in writing within 48 hours of the proposed change. <br /> 5. CONCESSIONS <br /> The Tennis Program is not authorized to sell concessions. <br /> 6. REVENUE AND FEES <br /> a) The Tennis Program shall pay to the City fees established by and in accordance with Exhibit B (PROGRAM FEES). <br /> b) The City may review and/or modify the fees owed to the City on an annual basis. <br /> 7. MAINTENANCE <br /> The Tennis Program shall be solely responsible for returning the Tennis Courts to a substantially similar or better <br /> condition after each use of the Tennis Courts. Any damage or destruction to the Tennis Courts related to the Tennis <br /> Program use of such Tennis Courts under this Agreement shall be promptly repaired by the Tennis Program to the same <br /> condition that existed prior to the damage or destruction. <br /> 8. CONDUCT <br /> a) The Tennis Program is responsible for the conduct of employees,agents, contractors,teams, players, coaches, <br /> spectators, invitees and guests. The Tennis Program shall provide copies of Exhibit C (TENNIS COURT RULES AND <br /> REGULATIONS) to all participants and shall enforce all rules and regulations with respect to Tennis Program <br /> employees, agents, contractors, teams, players, coaches, spectators, invitees and guests. The Tennis Program <br /> shall suspend from one or more events,employees, agents, contractors,teams, players, coaches, spectators, <br /> invitees or guests who violate any rules and regulations in Exhibit C(TENNIS COURT RULES AND REGULATIONS). <br />
