• WHEREAS, the owners of more than two-thirds of the private property abutting upon the portion of street above described have duly filed their petition with the City Council of Everett, praying for the vacation of said portion of street; and } WHEREAS, said City Council of the City of Everett did, by resolution duly adopted, fix the 9th day of September, 1948 at 10:00 o 'clock A. v?. of said day for the hearing' and determination of said petition; and WHEREAS, due and legal notice of the time and place of said hearing and the determination of said petition has been given by the City Clerk in the manner required by law; and WHEREAS, at the time and place fixed for hearing, no ! persons appeared or made objections to the vacating of the herein described portion of street and no objections of any kind were made ,f to the granting of said petition; and WHEREAS, it now appearing to the City Council that said petition should be granted and said Council does hereby determine to vacate the above described property, NOW, THER sFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the property in the City of Everett, County of Snohomish, State of 4uashington, described as follows, to-wit: A road forty feet (40 ' ) wide, being twenty feet (20 ' ) on each side of a center line described as follows: Beginning twenty feet (20 ' ) northerly on the west line of Verdurette Avenue extended, (In the NE4, Section 36, Township 29 North, Range 4, :E.WW.M. as described in the Book of Leeds, 173, page 567 the point of beginning; thence parallel to the northerly line of the South one-half of the Northeast quarter of the aforesaid section 36, Township 29 North, Range 4, E.W.M. North 88°45 '10" east for a distance of 487.32 feet to a point that is twenty feet (20 ' ) north of the center from the north line of i e extended 1 ine of Forest Drive rarest Park Addition to Everett; thence angle left 90° north 1°14 '50" west for a distance of 70 feet to point of curve; thence on a curve to the right with central angle 48007 '30" and radius 95.784 feet for a distance of 80.45 feet; thence along tangent north 46052 '40" east for a distance of 225.81 feet to point of curve; thence curve to the left with central angle 16°35 '30t4 and radius 573.686 feet for a distance of 166.13 feet to point of tangent ; thence north 30°17 '10" east for a distance of 349.64 feet to point of curve; thence curve to left with central angle of 31056 ' and radius 231.011 feet for 28. 29 feet to an intersection with the east line of Section 36, Township 29 North, Range 4, containing 1.285 acres more or less. -2-
