• Section 114: MUST HAVE FOUR LVH: ELS ON ROAD WHILE OPERAT- ING. It shall be unlawful to operate or drive any vehicle or oombi- nation of vehicles over or along any pavement or gravel or crushed rock surface on a public highway with one wheel or all of the wheels off the roadway thereof, except for the purpose of stopping off such roadway, or having stopped thereat, for proceeding back onto the pavement, gravel or crushed rock surface thereof. Section 115: LOAD CANNOT EXTEND BEYOND FENDERS ON INSIDE. No passenger type vehicle shall be operated on any public street with any load carried thereon extending beyond the line of the fenders on the left side of such vehicle nor extending more than six (6) inches beyond the line of the fenders on the right side there- of. Section 116: DRIVING WHILE INTOXICATED. It shall be un- lawful for any person to operate any vehicle upon the public highways or alleys of this city while under the influence of or affected by the use of intoxicating liquor or of any narcotic drug. Upon the first conviction for the violation of the provisions of this section the court shall impose a fine of not less than w50.00 or more than three hundred dollars ( 300.00) , or by imprisonment for not less than ten (10) days or more than ninety (90) days in the city jail, or by both such fine and imprisonment, and shall, in addition thereto, revoke the operator ' s license of such person. Upon second or subse- quent conviction for a violation of the provisions of this section the court shall impose a fine of not less than 100.00 or more than y300.00, or by imprisonment for not less than thirty (30) days or more than ninety (90) days in the city jail, or by both such fine and imprisonment, and shall, in addition thereto, revoke the operator ' s license of such person. Section 117: PREVENTION OF DRIVING WHILE INTOXICATED. Whenever it appears reasonably certain to any police officer that any person under the influence of, or affected by the use of, intoxi- cating liquor or of any narcotic drug is about to operate a motor vehicle in violation of this ordinance, said officer may take reasonable measures to prevent any such person from so doing, either by taking from him the keys of such vehicle and locking same, or by some other appropriate means. Section 118: RECKLESS DRIVING. (a) It shall be unlawful for any person to operate a motor vehicle in a reckless manner over and along the public high- ways of the 'ity of Everett. For the purpose of this section to "operate in a recklessmanner" shall be construed to mean the operation of a vehicle upon the public highways of th=s city in such a manner as to indicate either a wilful or wanton disregard for the safety of persons or property. (b) It shall be unlawful for any person to operate a motor vehicle when such person has in his or her embrace another person which prevents the free and unhampered operation of such vehicle. Any person so doing shall be ddemed guilty of reckless driving. (c) The unlawful operation of a vehicle in excess of the maximum lawful speed permitted by this ordinance at the point and under the circumstances of operation shall be prima facie evidence of reckless driving by the operator thereof. -35-
