• <br /> Section 114: MUST HAVE FOUR LVH: ELS ON ROAD WHILE OPERAT- <br /> ING. It shall be unlawful to operate or drive any vehicle or oombi- <br /> nation of vehicles over or along any pavement or gravel or crushed <br /> rock surface on a public highway with one wheel or all of the wheels <br /> off the roadway thereof, except for the purpose of stopping off <br /> such roadway, or having stopped thereat, for proceeding back onto <br /> the pavement, gravel or crushed rock surface thereof. <br /> Section 115: LOAD CANNOT EXTEND BEYOND FENDERS ON INSIDE. <br /> No passenger type vehicle shall be operated on any public street <br /> with any load carried thereon extending beyond the line of the <br /> fenders on the left side of such vehicle nor extending more than <br /> six (6) inches beyond the line of the fenders on the right side there- <br /> of. <br /> Section 116: DRIVING WHILE INTOXICATED. It shall be un- <br /> lawful for any person to operate any vehicle upon the public highways <br /> or alleys of this city while under the influence of or affected by <br /> the use of intoxicating liquor or of any narcotic drug. Upon the <br /> first conviction for the violation of the provisions of this section <br /> the court shall impose a fine of not less than w50.00 or more than <br /> three hundred dollars ( 300.00) , or by imprisonment for not less <br /> than ten (10) days or more than ninety (90) days in the city jail, or <br /> by both such fine and imprisonment, and shall, in addition thereto, <br /> revoke the operator ' s license of such person. Upon second or subse- <br /> quent conviction for a violation of the provisions of this section <br /> the court shall impose a fine of not less than 100.00 or more than <br /> y300.00, or by imprisonment for not less than thirty (30) days or <br /> more than ninety (90) days in the city jail, or by both such fine <br /> and imprisonment, and shall, in addition thereto, revoke the operator ' s <br /> license of such person. <br /> Section 117: PREVENTION OF DRIVING WHILE INTOXICATED. <br /> Whenever it appears reasonably certain to any police officer that <br /> any person under the influence of, or affected by the use of, intoxi- <br /> cating liquor or of any narcotic drug is about to operate a motor <br /> vehicle in violation of this ordinance, said officer may take <br /> reasonable measures to prevent any such person from so doing, either <br /> by taking from him the keys of such vehicle and locking same, or <br /> by some other appropriate means. <br /> Section 118: RECKLESS DRIVING. <br /> (a) It shall be unlawful for any person to operate a <br /> motor vehicle in a reckless manner over and along the public high- <br /> ways of the 'ity of Everett. For the purpose of this section to <br /> "operate in a recklessmanner" shall be construed to mean the <br /> operation of a vehicle upon the public highways of th=s city in such <br /> a manner as to indicate either a wilful or wanton disregard for the <br /> safety of persons or property. <br /> (b) It shall be unlawful for any person to operate a <br /> motor vehicle when such person has in his or her embrace another <br /> person which prevents the free and unhampered operation of such <br /> vehicle. Any person so doing shall be ddemed guilty of reckless <br /> driving. <br /> (c) The unlawful operation of a vehicle in excess of the <br /> maximum lawful speed permitted by this ordinance at the point and <br /> under the circumstances of operation shall be prima facie evidence <br /> of reckless driving by the operator thereof. <br /> -35- <br />
