r • The notice required in the above section shall be complied with by the mailing of a notice to the street address of the premises on which said septic tank is located, addressed to the occupants thereof, and mailing of a notice to the owner of record of such premises, or if such owner' s place of residence cannot be ascertained, then by the posting of a notice upon the building or structure to which said septic tank is connected. Section 10: It shall be the duty of every owner or occupant to open for inspection any drain line, filter trench or septic tank heretofore constructed upon the request of the plumbing inspector in order to provide the plumbing inspector with opportunity to inspect such facilities. Section 11: It shall be the duty of all owners and occupants of premises using septic tanks to at all times maintain the same in such a manner as to protect the public health and welfare; and in event a septic tank shall fail to properly function although constructed in accordance with this act, the same • shall be forthwith reconstructed in order to place the same in a sanitary condition. Section 12: Any person, firm or corporation who violates or refuses or fails to comply with any of the provisions of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine of not less than Twenty-five Dollars ( 25.00) nor more than One Hundred Dollars ($100.00). Section 13: Every person, firm or corporation shall be deemed guilty of a separate offense for every day during any portion of which any violation of any provision of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as provided by this ordinance. Section 14: If any section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Council of the City of Everett hereby declares that it would have passed this ordinance, and each section, sub-section, sentence, clause and phrase thereof, irrespective of the fact that any one or more other sections, sub-sections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 15: That Ordinance No. 2848 be and the same is hereby repealed. Section 16: That a public emergency exists for the reason that no adequate ordinance is now in effect which covers properly the installation and maintenance of a septic tank,and by reason thereof conditions detrimental to the public health are in evidence; : that therefore a, public emergency exists and this ordinance shall take effect upon its passage and publication.
