r • <br /> The notice required in the above section shall be <br /> complied with by the mailing of a notice to the street address of <br /> the premises on which said septic tank is located, addressed to <br /> the occupants thereof, and mailing of a notice to the owner of <br /> record of such premises, or if such owner' s place of residence <br /> cannot be ascertained, then by the posting of a notice upon the <br /> building or structure to which said septic tank is connected. <br /> Section 10: It shall be the duty of every owner or <br /> occupant to open for inspection any drain line, filter trench or <br /> septic tank heretofore constructed upon the request of the plumbing <br /> inspector in order to provide the plumbing inspector with opportunity <br /> to inspect such facilities. <br /> Section 11: It shall be the duty of all owners and <br /> occupants of premises using septic tanks to at all times maintain <br /> the same in such a manner as to protect the public health and <br /> welfare; and in event a septic tank shall fail to properly <br /> function although constructed in accordance with this act, the same <br /> • shall be forthwith reconstructed in order to place the same in a <br /> sanitary condition. <br /> Section 12: Any person, firm or corporation who violates <br /> or refuses or fails to comply with any of the provisions of this <br /> ordinance shall be guilty of a misdemeanor and shall be punished <br /> by a fine of not less than Twenty-five Dollars ( 25.00) nor more <br /> than One Hundred Dollars ($100.00). <br /> Section 13: Every person, firm or corporation shall be <br /> deemed guilty of a separate offense for every day during any <br /> portion of which any violation of any provision of this ordinance <br /> is committed, continued or permitted by such person, firm or <br /> corporation, and shall be punishable therefor as provided by this <br /> ordinance. <br /> Section 14: If any section, sub-section, sentence, <br /> clause or phrase of this ordinance is for any reason held to be <br /> invalid or unconstitutional, such decision shall not affect the <br /> validity of the remaining portions of this ordinance. The Council <br /> of the City of Everett hereby declares that it would have passed <br /> this ordinance, and each section, sub-section, sentence, clause <br /> and phrase thereof, irrespective of the fact that any one or more <br /> other sections, sub-sections, sentences, clauses or phrases be <br /> declared invalid or unconstitutional. <br /> Section 15: That Ordinance No. 2848 be and the same <br /> is hereby repealed. <br /> Section 16: That a public emergency exists for the reason <br /> that no adequate ordinance is now in effect which covers properly <br /> the installation and maintenance of a septic tank,and by reason <br /> thereof conditions detrimental to the public health are in evidence; : <br /> that therefore a, public emergency exists and this ordinance shall <br /> take effect upon its passage and publication. <br /> Mayor <br /> Attest: May <br /> /frh p41/114 <br /> terk <br /> Passed: May 18th, 1948. <br /> Published: " 20th, 1948 . <br /> -4- <br />
