4 <br /> ORDINANCE NO. 3182 . <br /> AN ORDINANCE providing for the improvement of Fulton Street <br /> and Fulton Avenue from Hewitt Avenue to Pacific Avenue by paving <br /> the same with Portland cement concrete pavement and including as <br /> part of such work the necessary widening , the installation of all <br /> needed surface drainage, the construction or reconstruction of all <br /> sewers, side sewers, water mains and hydrants with necessary <br /> appurtenances, the construction or reconstruction of all concrete <br /> curbs and sidewalks where necessary, by such grading or regrading <br /> as may be necessary and by doing such other work as may be necessary <br /> in connection therewith to make a complete improvet, all in <br /> accordance with Resolution No. 5283 of the City of Everett, creating <br /> a local improvement district ; creating a local improvement district <br /> fund therefor; providing that fifty per cent ( 50%) of the cost of <br /> that portion of the improvement involving grading , construction <br /> of surfacing and pavement , engineering expenses and advertising <br /> shall be paid by funds from the Washington State Development Board, <br /> the remaining cost shall be borne by and assessed against the <br /> property liable therefore in said district under the mode of <br /> payment by bonds. <br /> W.WfHEREAS, by Resolution No. 5283 the City Council of the City <br /> of Everett has declared its intention to order the improvement as <br /> above outlined, and doing all work in connection therewith to make <br /> a complete improvement in accordance with the plans and specifications <br /> as prepared by the City Engineer of the City of Everett. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Fulton Street and Fulton Avenue from Hewitt <br /> Avenut to Pacific Avenue be paved with Portland cement concrete <br /> pavement and including as part of such work the necessary widening, <br /> the installation of all needed surface drainage, the construction <br /> or reconstruction of all sewers , side sewers, water mains and <br /> hydrants with necessary atenances , the construction or recon- <br /> struction of all concrete curbs and sidewalks where necessary, by <br /> such grading or regrading as may be necessary, and by doing such <br /> other work as may be necessary in connection therewith to make a <br /> complete improvement, all according to the plans and specifications <br /> prepared under the directionof the City Engineer and which plans <br /> and specifications are hereby adopted and approved. <br /> Section 2: That the cost and expense of such improvement <br /> including all necessary and incidental expenses, shall be borne <br /> as follows: <br /> Fifty per cent (50%) of the cost of that portion of the <br /> improvement involving grading , construction of surfacing and pave- <br /> ment , engineering expenses and advertising shall be paid by funds <br /> from the Washington State Development Board, the remaining cost shall <br /> be borne by and assessed against the property liable therefor in the <br /> district herein created in accordance with law. <br /> The City of Everett shall not be liable in any manner for <br /> any portion of the costs and expenses of such improvement except <br /> as provided by Chapter 141 Session Laws of 1923, or acts amendatory <br /> thereto, and the ordinances of the City of Everett. <br /> -1- <br />
